Hi all,
Any advice\reassurance that can be offered for the below case would be greatly appreciated.
November 2012 - Stayed in holiday flats with attached car park. Upon arrival found large 4x4 taking up parking space designated to flat. So parked in visitor bay until 4x4 had left and then moved car to designated space. No parking ticket attached to car at time.
March 2013 - Received ‘Notice to Keeper\Hirer’ letter from Parking Collection Services advising we parked in a bay without “displaying a valid parking permit”.
April 2013 - Second and Third letters from Parking Collection Services. Now received a letter from Debt Recovery Plus advising matter will be passed to solicitors to commence county court proceedings.
No appeal method has been advised in the letters. They have so far all been demands which we have ignored.
- Are we best to continue ignoring in this case?
- We have not appealed to PCS as no method has been communicated. I don’t believe we can appeal to POPLA because of this however. Is this correct?

Parking Collection Services are members of the BPA AOS scheme which is how they got the registered keeper details from the DVLA. However if no ticket (Notice To Driver) is left on the car then if they wish to use POFA 2012 to invoke keeper liability they must make sure that the Notice To Keeper is delivered within 14 days (not just posted off but actually received within 14 days). If the NTD is left on the car then if they wish to use POFA 2012 to invoke keeper liability they cannot send a NTK less than 28 or more than 56 days after the event. So whichever timescale you look at they have missed the boat. They cannot cite keeper liability but only pursue the driver for this fake charge but unless you tell them they don't know who the driver is.
Was there really nothing about an appeal to PCS or if that is rejected then an appeal to the "independent" body POPLA?
Just ignoring these empty threats about a fake parking ticket is the easiest thing to do.0 -
PCS are not a parking company. So at no point have you even been told who the alleged 'creditor' (parking company) is then?!
PCS and Zenith and Debt Recovery Plus are all from the same useless stable of debt collectors. None of them put the fake ticket on your car. You've never had a chance to appeal at all then - except for in the Notice to Keeper (NTK) where you still couldn't see who issued the fake PCN? Have a look at the bottom of the NTK and it should mention a name of a parking company somewhere, just so you know! And the NTK was where they should have offered POPLA - so yes you are well past that stage. No worries!
Anyway you must continue to ignore these letters. I am getting a bit bored posting this as the DRP letters aren't THAT scary!! But I can see the latest one has bothered you, just as it did these posters when they first posted on pepipoo forums:

...I post there as SchoolRunMum and as you can see, I don't recommend raising your head above the parapet when at the moment your data is among thousands of unconfirmed details on DRPlus' threatogram list.
I see a reply at this stage as utterly pointless and even more likely to mark you out as a victim, who may well fold and pay if they just step up the intimidating letters even more. IMHO to contact them now would be like saying 'here I am and even though I have ignored them, your letters are getting through to me and I am reading them, why not send me more and I might just be scared enough to pay'.
Keep all the letters safely filed in a folder or drawer marked 'scam'! If ever a parking company tries a (very rare!) small claim then that's the time to post back here and on pepipoo for a robust defence, and you'd have that mish-mash of letters as part of your evidence. You do not need to take any action at all, whilst simply getting the usual letters which 99.9% of the time just fizzle out in the end.
After all, the letters are all shown on our sticky thread anyway!

Chances of it heading towards court is less than 0.005%
Just think, it's been nearly 6 months since the "breach of contract", would any company wait 6 months to take you to court if they think you owe them money and had a winnable case?0 -
All of there begging letters if shredded will come in handy for a nice warm bed if you have a pet mouse or hampster :money:PPCs say its carpark management, BPA say its raising standards..... we all know its just about raking in the revenue. :eek:0

Or you could keep them, just in case you bring an harassment case against the retailer.0
