Town & City Parking Ltd/Smart Parking

Hi
Received a parking charge notice on Wednesday from Smart Parking for £60 as we apparantly ignored the original ticket that was issued at Forth Valley Hospital in Larbert in March! We've never had a ticket to our knowledge! We were parked in a FREE carpark at a brand new hospital - no idea what we've supposed to have done as the PCN has no details. Went and took pictures of the car park signs yesterday and nowhere on the sign does it mention Smart Parking - says the car park is run by Town and City Parking Ltd. Think it is despicable that people who are visiting a hospital - usually not for a happy event - are being targeted in what is basically a money making scheme. Can these tickets be enforced - I've read other posts, but mostly in England and I know the rules are different in Scotland - can anyone help?

Thanks Ellie for creating a new thread on this. First I'll answer your question, yes it's safe to totally ignore Smart Parking in Scotland, there is no independent appeals there unlike England and Wales. So they won't know who is driving, and you have no legal obligation to name the driver regardless of what they say. Providing its your car.
It's highly unlikely that they will attempt any claim against you, and in fact they will try and say you are liable under English law and they will make a claim in the small claims, utter rubbish of course. So just ignore them.
To my question, does that sign actually say Town and City Parking Ltd exactly ? The Ltd part is the important part as that company doesn't exist anymore, Smart Parking bought them out and that name was discarded and is no longer legally allowed to be used, images would be niceWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. Yes - defo says LTD -went and took pictures yesterday as I had seen a bit about them being banned by the DVLA. Pictures on hubbies phone who is at work, but can post them!0 -
Better to send an email to the dvla with something like this

I had a private parking ticket from Smart Parking Ltd at xxxx car park on the xx/xx/2013, on investigation of the signs in the car park a completely different parking company is situated on this site called Town and City Parking Ltd.
I am concerned that one company has ticketed me, but another has apparantely been given my details, where is the data protection act in this? Why is one company who appears to have a contract as on their signs, and a different one is pursuing me?
I would like to know if the dvla is going to give registered keeper details to these companies ? And which one will have my confidential information. I look forward to your interpretation of this situation .
