I'm having bother with them too, but today found out that they cannot send a bailiff to your door unless you dont pay them and they give you a county court judgment, then after you fill in the forms that come in the post (the ccj) and start the payment plan, only if you default on the ccj can they send someone to your home (bailiff). If the bailiff comes he cannot force entry so keep all windows and doors locked and simply ignore the knocking !
If its AIC themselves who would come visit you whats the big problem ? What exactly do you think they're going to do ? Tell them that you cannot afford to pay this sum, and that you're willing to set up a payment plan. If they dont like it tell them that you'll send them a pro rata letter and budget form and wait for the response.
Them calling you a couple of times a week is ok, if they start calling you 3 or 4 times a day you can make an official complaint as (the guidelines say) this is harassment.0 -
Ring 0808 808 4000 its the national debtline, you dont need to give your personal details if you dont want, everything is confidential and free and they'll give you all the advice you need and tell you exactly how to handle AIC.0

Almost everyone in this thread seems scared to death of being visited in some surprise attack? They can't come round without telling you first, they can't do anything at all legally while you dispute the debt.
If they try to get a CCJ, then the court will tell you so that you can defend yourself...it won't' just happen without you knowing about it.
Please take the time to read as many threads here as possible, it's all here complete with links to the laws concerned. It will save you so much worry to know that their threats are empty and in fact they are the ones more likely to feel the force of law for their illegal actions chasing debts they bought for about 10p in the pound .
Doorstep visits can't happen out of the blue. Incideantally...nor can they communicate any of the business to any third party or ring you at work....that's not allowed and will also get them in trouble (and hopefully losing their licence ).

If they did turn up on your doorstep they have very little legal rights. DO NOT let them into your property at all and DO NOT sign anything however officvial looking it might look or sound. They can only enter your property if a door or window is open or you let in. The only way the legally enter your home without your permission is if they have a court order. For this the county court would firstly let you know of the date of the hearing and normally they would agree a sensible repayment plan if the debt is unsecured.

As not to confuse matters and I am sure this advice was given in good faith BUT the OP is reffering to Doorstep Collectors NOT Bailiffs.
Doorstep Collectors have naff all rights and CANNOT enter your home regardless of anything being left unlocked or open. They have NO powers or authority whatsoever and you can quite lawfully tell them to Jog On.
For Bailiffs to become involved the matter firstly has to go before a Court and then you have to have defaulted on the instruction of the Court before it even becomes a possibility of having Bailiffs on your case.
As this is not the case then the threat of a doorstep visit is merely an attempt by the DCA to have you misbelieve that they are sending Bailiffs. The DCA rely on your lack of knowledge in order to scare you into submission. If a Doorstep Collector does by any slim chance turn up tell em to do one or you will call the Old Bill.
No CCA = Unenforceable = Go Whistle Dixie.
They HAVE to send you the CCA and Deed of Assignment. If they fail to comply they are in Default and until such time as they produce a compliant CCA then they are unable to enforce the debt whatsoever.
Take a look at the Unenforceability and Template Letters Thread by neverindoubt it is sitting on the first page of the forum most days.
My advice is have a good read learn your rights as knowledge certainly is power. If you are unsure about anything just post up and someone will always help.0 -
Sorry Andy but there are multiple people on here and we will help anyone who is struggling. Template letters we keep in a sticky at the top of the board for the use of whoever needs them.
There is no need for anyone to PM you, email you or phone your mobile number. I notice you are a new poster if you want to help people using your knowledge of the rules just keep posting advice on peoples threads.

I have recently started receiving threatening phone calls from this company over an alleged debt of £65. They ask your name and then request you provide confirmation of personal information. I employ the following tactic which seems to work. My reply is as follows: " For security reasons I require to know, 1. who you are and 2, what is this call in relation to". Their stock response is to waffle that they cannot answer this request without you first confirming your details. Stick to the response that you are not prepared to divulge this information without knowing what it is about. It really P's them off and they hang up. They still call me but it's only about once a month now not every 2 or 3 days (including Sundays). They are just bullies and like all bullies they don't like it when someone stands up for them self.0
