Slanging match with Allied International Credit

I posted a thread on here a few weeks ago regarding Allied International Credit. They are chasing me for full outstanding payments for Tesco and Mint credit cards. They said that I would have to pay it all by 30th April, it was impossible for me to find £3300 within a month, so I begged and pleaded for advice. It was unanimous that I shouldn't attempt to ge6t another loan, so I wrote to them recorded delivery asking for my CCA with two cheques, one for each credit card. I since got a letter asking why I had failed to pay up, I ignored this letter as I thought the letters had crossed in the post. Yesterday I arrived home to find two identical letters - Notification of Intended Visit. I rang up and finally got through to somebody this afternoon, asking why I had not yet received my CCA. He started shouting at me asking why I wanted it - I said because I was entitled to it etc, and he just continued to shout why, why why??? He refused to send it to me, saying that they wouldn't give it to me and that I should try and get it from the credit card companies. Surely I was right to ask AIC for it?? Why wont they send it to me? He accused me of biding time and ended the conversation with "see you in court" before putting the phone down on me.
Help! What do I do now? I am in a situation where I will be able to pay £300 a month if they send me my CCA, but cannot sit at home in fear of people banging on my door! Will they come round? What will they do? What should my next move be? And how do I go about reporting their bullying behaviour???:eek:

Ignore them - I get phonecalls like yours from this company at least once a month - they are trying to scare you into paying more than you can afford - They shout at me down the phone, which is usually when I tell them to bog off and drop the phone on them. - i am paying the company that the debt was originally with (natwest visa) firstly that will mess up the paperwork and as you are actually paying something, I doubt very much that you would ever see the inside of a courtroom.
I said I was paying the company direct He then gets all nasty and says - you don't have an agreement with Natwest (had I thought about it before launching my next defence I would have said - well why the hell are you chasing me then - but didn't think of it until afterwards) I then said well I definatley don't have any agreement with you!
They are the rudest obnoxious company i have ever had to deal with
I have asked them for the deed of assignment - they claim no such thing exists and I don't know what I'm on about.
I think they get off on trying to scare you.
The last call I had was a couple of days ago - the shouting started I put the phone down - they rang back instantly and hubby took the call - asked to speak to me, hubby said no - they then said to hubby are you covering for her at which point hubby said who the £$%^ do you think you are and also dropped the phone.
Don't let them scare you
Write them a short and to the point letter INSTRUCTING them to stop telephoning and to REMOVE your number from their system or flag it with instructions NOT to ring. (keep a copy and send it recorded delivery)
By law they have to comply (this doesn't mean that they wont ring - but it does mean you can start compaling to the relevent people that deal with harrasment.

From his attitude they obviously havent got the a copy of the CCA so legally they do not have a leg to stand on. They can threaten as much as they like but legally they cannot do anything.
Have you sent an official follow up letter? I assume that you sent the template letter that is common on ths site? If so you need to write to them informing them that as you have not received the copy of the CCA you will be reporting them to the Office of Fair trading and the other industry watchdogs.
If they did turn up on your doorstep they have very little legal rights. DO NOT let them into your property at all and DO NOT sign anything however officvial looking it might look or sound. They can only enter your property if a door or window is open or you let in. The only way the legally enter your home without your permission is if they have a court order. For this the county court would firstly let you know of the date of the hearing and normally they would agree a sensible repayment plan if the debt is unsecured.
These are typical bullyboy tactics. you have done nothing wrong. The reason he was shouting is because he probally knows he hasnt got a case and is frustrated that his profit is slipping away from him.

Here is a template letter you can send to stop the phone calls.
"Dear
I am writing to express my serious concerns regarding the telephone calls that I have received from your company.
I am now formally requesting that all further correspondence be made in writing only.
I demand that these phone calls stop immediately. I am familiar with the terms of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1970 and I believe your harassment places you in breach of these acts.
If you continue to call, you will also be in breach of the Wireless Telegraphy Act (1949) and, as such, I will report you to both Trading Standards and The Office of Fair Trading.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
You will be deemed to have been served notice of my request and I will deem it served by (FULL DATE), I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.
Yours faithfully,"

I feel like a right nugget as I rang them, knew it was a mistake as they only antagonise me!!! The CCA request was sent recorded on 25th April, one cheque was cashed on 3rd of May, so how long before I send a follow up letter? and where do I find it? I told him that i wouldn't be paying them a penny unless they provided a CCA. He made it out as though I didn't know what i was talking about. Admittedly I'm not terribly clued up on it all but having read countless threads, I think I've got the gist of it, and wouldn't start quoting stuff unless I was adament that it was well within my rights. He said he wouldn't send me my CCA but he'd bring it to court? What a &!%* eh??? Ooooh, it gets me so angry!!! Can I send a nasty letter back or should I remain calm and dignified???:mad:0

I would have REALLY taken the píss if this was me. Laughing at his shouting, singing 'you havent got it - UNLUCKY!!!' down the phone would have cheered me up considerably.Debt as at 12th July 2006 - £61,345 :eek: :eek: :eek:

I think they have 12 days to provide the CCA after that they are in default but you have to wait 30 days before they have committed an offence. Im sure someone will be along shortly who can def confirm this for you

as long as they dont provide it they are breaking the law and until such time as they do provide it they cant enforce the debt!!!

As far as I am aware they are already breaking the law by contacting you after you have sent a CCA request. They can only continue to harrass you if they have supplied the CCA, which obviously they haven't. They are not allowed to contact you again until they supply the CCA.0

I also had dealings with this company back in January 2006. Owing £1700.00 against RBS credit card. I had terrible phone calls from them. They reduced the figure for me as I was very lucky I was waiting on some final payment from my employers to pay out. I couldn't wait to get them of my back. Once paid about 3 weeks later I had a phone call from them to say they where short of £72.00. Told them this was the figure I had and I had no further monies to give out. Never heard from them again.
