car accident - advice please

    do you think I should write to the police , ask if there are going to take proceeding against the 3rd party ?

    No doubt you have the dealing officer's details for your insurance claim so why not simply ring and speak to him/her? They may be able to help you with witness details at least. From your account, I don't think you have much to worry about. But the TP's insurers will no doubt try and avoid liability (which is par for the course) so having witnesses will speed things up.

    Sorry but irrespective of blame the police will be concerned of everybodies well being, not just the well being of the victim.

    thanks guys, I bit green on all of this, I did have serious motorcycle accident when 17 (not my fault I hasten to add), long time ago now !

    Tuesdays accident brought back some nasty memories for me, and a second or two earlier, I would have come off a lot worse.

    I have not telephoned local police yet, I have incident number, but, last evening 3rd party insurers LV phoned me, asking if I needed courtesy car, and they said their client had admitted liability.

    would you still advise I telephone police and ask if there is going to be any course of action against 3rd party ?

    dont get me wrong, I am not after his scalp, but, I do feel this was a dreadful act of driving without due care and attention (this was not a case of someone nudging out of give way junction clipping my car, he shot across the junction at speed), and he was fortunate that I did not suffer long lasting injuries
  • your entitled to call the police with your incident number the police then give you an appointment to come and take your statement and ask you do you wish further action taken, go to court to give evidence if need be etc.

    Ok, so TP's insurers are playing ball early. Good news so take them up on their offer and let them sort everything out.

    If the police have managed to take statements that shows they are investigating the incident so it may be the case that they will prosecute the driver without you 'pressing charges' which TBH, the police should of asked you at the scene.

    If you choose to follow this up with the police, it should not prejudice your claim with LV now they have admitted liability. So it's up to you really.

    You might want to edit your recollection for clarity.
    "a car drove straight across a give way junction/cross roads, and slammed into my right side, "
    If it was an uncontrolled crossroads he may well be complaining to the police now he has had time to think of it about the driver who shot out in front of him and caused the crash.
