car accident - advice please

I was involved in car accident Tuesday 23.4.13

at 5-40pm ,

a car drove straight across a give way junction/cross roads, and slammed into my right side,

I have suffered concussion and bruising,

I do have good insurers, they use Minster Law, who are acting on my behalf to make a claim against the 3rd party,

my car was write off, and is being taken away by a company called Copart, who are taking car away today, I believe

I am at home recovering at mo,

please can you advise what I need to do regards DVLA, I guess they need informing some how that the car has been write off,

also any other advice welcome, wrt claims in this situation, I am keeping log of expenses incurred, photos of injuries

any other advice welcome from those been in similar situation

    When I was in a similair situation, once the my insurance payment had been agreed my insurance company asked me to complete the V5 stating that I had sold it to them, I assume that the insurance company would then sell the car to the salvage company and inform the DVLA what category the damage came under. I could be wrong though...

    Your best bet would be to speak to your insurer - a lot will depend if the vehicle is going to be scrapped or repaired, and that is entirely up to your insurer once they've settled the claim and "bought" the car off you.

    hi..complete V5c/3 tear-off portion, send to DVLA, and [I think] give the rest of the V5c to Copart?
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    My car went through Copart. You'll send the V5 to the insurance company. Copart might well sell your car on. They did mine.
    What if there was no such thing as a rhetorical question?

    Do none of the above, don't presume the matter is done and dusted, just do what your insurers tell you to do (although they've already sent it off to the US based scrap reseller that destroyed the UK cat c/d business).
    Some insurers want the complete V5C, others will do the (incorrect) scrapping process. You will be following their lead.

    Just as an aside "do non of the above"

    I didn't actually tell the OP to do anything. As you say, the insurance comapny will lead on it. I was simply reporting my experience.

    Whatever you do, make sure that the yellow V5/3 part of the V5C is completed and that you send it to the DVLA, do it at a Post Office and get a proof of posting.
    If you don't get their acknowledgment letter in four weeks, contact them.

    I'm assuming the police were involved as you were injured so can I ask if there any likely proceedings against the third party as by the sounds of it, the collision was a result of a road traffic offence?

    I'm assuming the police were involved as you were injured so can I ask if there any likely proceedings against the third party as by the sounds of it, the collision was a result of a road traffic offence?

    yes, police involved, and my insurers are going for claim against his,

    that is good point, he shot straight across cross roads, where he clearly did not give way, he kept saying sorry, and there were plenty of witnesses. But, I was whisked into ambulance pretty quickly, so I did not have chance to get names, addresses of witnesses, guess the police would have taken statements ?

    do you think I should ask my insurers if the police have taken action?

    I have had IM Solutions, Copart, local garages contact me,

    all on top of insurers, and Minster Law

    no wonder premiums are so high,

    It's just that the same thing happened to me once; old guy comes straight across a give way and broadsided me totaling both cars (mine was just 3 weeks old at the time!). He admitted liability at the time and I had witnesses but when it came to the insurance claim, his (naturally) disputed liability.

    The police asked me if I wanted me to report the TP for any offence as they could see that he had failed to give way but as he had admitted liability, I decided not to. More fool me because had he been prosecuted, his insurers then have no where to go.

    In my case I wasn't injured but I had to claim hire car, excess and other un-insured losses so I wrote to the other driver directly and threatened legal action unless he coughed up. I suggested that he passed on my letter to his insurers and I got a cheque for all my un-insured losses within 14 days of me sending the letter.

    well done, great to see someone not let the ****** get away with it,

    this concerns me now, he was a doctor, and I am sure the police were treating him in a 'special' way, from the glimpse I caught from the ambulance,
