The buyer paid by paypal for a collection only item?

Yep! And now my paypal balance is negative because of the refund.

I do believe you were unwise to start a small claims court action.
    You have suffered no loss.

Not sure a scc action against ebay would work either, for the same reason - you have suffered no loss.

    Try the ebay board.

I was pretty miffed when I started it. (Damn you internet!) But I really feel that I trusted ebay to treat both parties fairly and abide by the rules. I did everything right and the buyer did everything wrong and ebay rewarded her. I feel that how can any seller be sure they won't be screwed over.

I'm not a ebay business seller, I was just getting rid of stuff. You say I suffered no loss but I wasted time when I was extremely busy trying to move house, and lost money.

Thanks for your replies. As a stubborn idiot I'm likely to go through with this despite your best advice.

    What money did you lose?
You still have the goods, don't you?

The Small Claims Court deals with claims for money. As you will be unable to quantify your loss - you tell us yourself your time isn't chargeable - you have no claim.

If you want to pursue a claim for anything else, you need the 'big claims court' and big money.

Do you understand that, had the buyer collected the goods, they could easily submitted an ebay claim - item not received - and received a full refund and kept the goods? Simply because you would be unable to show electronic proof of collection/delivery.
Head over to the ebay board and read some of the 'stickies' to help you protect yourself.

I know you are right, I'll cut my losses.

Will I need to ask for a continuance if I am able to contact the courts 1st thing Monday morning before they have had a chance to process my claim from the weekend?

    Thanks again.

Sorry, I simply don't know enough about court procedures to advise on that, so will have to leave that to others.

Your only losses are the court fees you've paid without thinking this through properly.

    Not at all.
I was only addressing your particular situation and confirming that you have incurred no actual loss.

Better to learn now rather than embarrassingly in court, surely?

Agreed. Which I why I decided to take wealdroam's sage advice and halt the claim.

The building insurance company has taken full responsibilty for the county court judgement on my name due to dispute with a neighbour. I sent to all credit companies i.e.; Experian, Equifax etc. a copy of the letter but have not heard anything yet. What should be the next step?
