    However, the details could be true because to ignore court papers = default win for the PPC and could happen where there is more than one ticket involved.

    You need a pepipoo defence so that you aren't missing anything.

    You are quite right about never ignoring court papers check and double check possible outcome.
    I have filed extra questions with PE and the court but so far no reply.

    Hello again everyone. I have now received an LBA, well actually several weeks ago. I intend to reply adapting the reply stroma is posting everywhere but have a few questions first. As far as I can see, PE has sent their NTK in time etc etc.

    1. Does the fact that I received the LBA some weeks ago make a difference? Does it make them more likely to forget me? I have not yet received any court stuff. What is the usual time period between an LBA and court papers?

    2. I don't have a receipt for the time in question (paid in cash and split the bill between friends). Should I do anything other than removing that bit of the letter?

    I would respond to any LBA, and make your case as DIFFICULT for them to deal with as possible making it clear you will fight this and you were a customer who will also complain to their clients who own/occupy the car park. We don't know the exact gap between an LBA and a small claim (weeks) but I wouldn't wait and see!

    If it were me I would be looking to make my response as full as any POPLA appeal (even though you are probably too late for POPLA unless PE send you a code out of the blue!). Make your case so strong that they don't pick yours for a small claim, but don't say who was driving of course.

    Look at PE POPLA appeal examples like this one for ideas even though this isn't a POPLA appeal - and check whether your original Notice to Keeper was received within 14 days and whether it identified the 'creditor' (won't have done if issued before May):

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Personally I would word it as a formal letter, long and strong (a real fightback letter) and send a copy to the CEO of Aldi telling him/her that you have seen the Aldi facebook page and are horrified to see how prevalent this harassment against paying Aldi customers is. Say you understand this is going to feature on a TV programme too and what exactly is Aldi's position when a person was a paying customer and is now at the mercy of a rogue parking agent whose only agenda is money. Clearly some cameras in a car park are ALL about making money and NOTHING about individual circumstances, customer service nor even any smidgen of 'parking management' which no doubt is how PE wheedled their way into Aldi car parks.

    Finish by saying (in the Aldi covering letter), is Aldi aware of Parking Eye v Somerfield and what happened there when PE were out of order with retail customers, have Supermarkets not learned a lesson from that case? Demand that your own ticket is rescinded without delay or you are minded to sue all parties for harassment.

    I sent PE a letter asking various awkward questions and have now received back their generic 3 page FAQ. Amongst other things they're going on about how their pre estimate of loss are just the general costs of running the business, which I'm sure I've read before is nonsense.

    Do I need to do anything now?

    You need to check your LBA against this very helpful advice given by zzzLazyDaisy about Practice Direction on Pre-Action Conduct. You will need to follow the steps YOU need to take, despite PE not following the steps THEY should have taken.
