Ombudsman has a time limit to get involved which falls into two criteria.
The first is 6 years from when the event first took place....... in this case it was end of 2008 when Santander failed to tell us about the cap margin. This now means they unable to assist.
The second is 3 years from when the complainant should have known or could have reasonably known of the issue.
The ombudsman has said that as our mortgage went SVR in 2010 then we should have noticed at that point that the rate was increased.
I've argued with them that its completely unfair to apply this as we were on a 5 year fix and had lots of things going on at the time. I'm not really sure anyone would get out their mortgage paperwork and compare the SVR from sign up to end of reduced rate. You just assume that the bank didn't lie and keep this information from you, don't you?!
I've also argued that Santander were supposed to have written to affected customers in 2013 when the FCA made their ruling and that puts it within the timeframe for them to help (Santander failed to do that). They're just not having it and simply wont look at the case.
We're now in the position where we've gone back to Santander for one last attempt at which point, should they not agree, its accept the compensation or go for a moneyclaim.
I'm therefore looking for some precedent that might have already been set or some indication from other forum members on the details of their compensation dates.0 -
