    I have quoted my earlier post (above), just to give some idea of a timeline for the letters I am receiving from Santander.


    This morning came the following letter......


    Dear ceegee,

    I wrote to you recently acknowledging receipt of your complaint.

    I am sorry it is taking longer than originally thought to investigate the issue and I would like to apologise for the delay and take this opportunity to thank you for your continued patience.

    Your complaint is currently being reviewed by a specialist team who will be in contact with you shortly to discuss your concerns in more detail.

    If for any reason we are unable to conclude our investigation over the next four weeks, we will contact you again to update you on our progress.

    Thank you for your understanding.

    Santander.

    Well, that's reasonably interesting I suppose, but I'm a little concerned about para 3 and wondering why they will be in contact shortly to discuss my concerns in more detail? Some questions that I am asking myself.........

    Are they having second thoughts? Unlikely, given the content of the letter I quoted above.

    Were my "answers" on the questionnaire not clear enough? Again, I should think that is unlikely as I was quite clear, honest and polite when stating the facts of the matter.

    Is it something to do with the fact that I chose the "other" option on the questionnaire, re staying with them on the SVR or going elsewhere or "other"?

    Has anyone else received a "holding" letter like this? Has anyone been asked to provide more information?

    My understanding is that they are "interested" in mortgages which were on a discounted rate linked to the SVR.......for example 0.5% off the SVR.

    That is the sort of mortgage I was on and their letters seem to indicate that I have been subjected to their naughty doings.



    Just my own thoughts on the matter, though.......:) I could be way off the mark! There were so many different types of mortgages......SVR linked ones, tracker ones, capped ones.......the mind boggles.

    I'm sorry that I cannot be of any real help to anyone; I am just updating as and when anything happens in my particular case. If any of it is of any use/ interest to anyone, then that is fine. If it isn't of any use/interest to anyone, well, there you go!

    Had second review letter through and surprise no change on the first investigation, but was concerned that they conducted a review without asking for any further information???

    What was noticeable there wasn't a single mention of their "balance of Probabilities" in the second and final letter, to all taking up the battle I believe they have set a precedence with the use of this statement.

    I have constructed my argument using their balance of probabilities with the B.O.P I am suggesting that our facts and circumstances at the time presented a more weighted argument that we were affected by their actions. Hoping that the FOS will turn the B.O.P on them. They have facts at their disposal to manipulate, messing around with statements such as B.O.P, I think it leaves them open.

    So get BOPPING!!!!

    Hi Everyone,

    I had a letter from Santander last week informing me of the cap margin error from 2008.
    I took out my mortgage in 2007 and it was a 5yr fixed deal with a 2 yr tie in to the SVR. As part of the mortgage we had our solicitors fees paid.
    At first I thought it was a good deal but I was kicking myself later for taking out a mortgage with a 2yr tie in.
    Anyway we moved house in April 2012 before the 5yr fixed term ended the following August.
    I asked Santander several times if we could get out of the ERC but they would not let us, so we ended up paying it in the end at £3200. This meant we had less money available for a deposit so the only deal we could get was with the Skipton on a 95% mortgage at 5.99%.
    I have filled in the questionairre in the hope that I can get my ERC back because if I had of known we could have delayed our move until the August and not paid the ERC!

    Hi all,

    Am finally getting around to filling in my FOS form after Santander decided I was not entitled to redress.

    As I have remained with them for several years on the SVR, their argument (on the balance of probabilities!) is that if I was unhappy about this rate I would have remortgaged to another lender.

    My mortage was a 2 year fixed rate of 5.84% in 2008 which then reverted to SVR.

    I'm struggling to get a decent argument together for the FOS though as I'm still very confused as to who will be eligible for redress.

    Any advice gratefully received!
