    .....don't worry about Bailiff's either. The Bailiffs can only become involved if Excel took you to court, they won their case, you were subsequently ordered to pay costs and didn't.

    Excel would have to go back to the Court and apply for a Judgment and then if you still didn't pay Excel would then have to apply for a Warrant of Execution. This is then when the Court Bailiff would be instructed.

    The way Excel word their notices makes it appear that the Bailiff's will be knocking at your door at Excel's say so.

    I would also go so far as to tell them to stop hunting you and if not then send them a bill for your time in sorting this out.

    I have done this to 2 companies who forced me to spend about 5+ hrs sorting things out. A quick online small claims proceedings and I not only got them off my back but they had to pay for my time.

    This only applies in a council-run car park. While companies are obliged by law to provide disabled parking spaces in private car parks, there is no law that says anyone can be fined for parking in such spaces.

    Anything you receive from a private car park is an invoice based on an alleged contract; nothing more than that.

    Surely the onus is on Excel to prove that a ticket wasn't purchased and it wasn't displayed? Do they take pix of all windscreens they don't find a ticket on?

    A few years back we all went to Scarborough for the day and I parked on the seafront near to the Spa Theatre (for those who know what I'm on about) That is council run. Our ticket fell off the screen and landed UPSIDE DOWN on the dash because of the sun melting the glue presumably. So when we returned to the car there was a fine on the windscreen.

    I was annoyed because you could see I'd got a ticket - you just couldn't read it. Anyway I went to the local police station and showed them my ticket. They said 'photocopy the ticket and send it to the Council with an explanantion and then forget about it'. So I did. Never heard anything more.

    Reason I'm posting this is that now in Spring, Summer and warm Autumns - I put a pair of socks rolled up under my ticket which I position near the bottom of the screen. No chance then of it falling off.

    Am I the only one here who doesn't stick the ticket to their windscreen? Mainly because I don't like the mess they leave behind, but also because I've heard of them falling off.
    But now I wonder if some over-zealous parking official might be tempted to slap me with a fine because I haven't followed the instructions to the letter...
  • Excel actually specify that the ticket must be attached to the front windscreen of your car - put it on the dashboard or side window and they will give you a ticket.

    Having done a bit more internet research (through some of the links provided on this thread - thanks again!!) have written to Excel stating that I had complied with my contractual obligations by buying and displaying ticket properly. Have told them to issue court proceedings within 14 days or to cease and desist from contacting me again and sent by recorded delivery. Am now crossing my fingers and hoping that they will finally go away!!

    Errata - They did provide a picture of the car with no ticket displayed, but you can't even see the whole windscreen. I'm also not denying it fell off (although I haven't admitted it either!!) I just think that it is as much their fault as mine i.e. they provide tickets that don't stick!!

    If they DO write to you again, demaning payment and telling you all kinds of stories to get their money, PLEASE DON'T pay them. They are nothing more than highway robbers.

    Don't pay them diddly squat. They use all the frightening language, so that innocent law abiding citizens will pay the fine, because they have been frightened into it!
