Previous landlady will not release deposit.

I moved out of my house that I rented for 5 years and the landlady will not release the full deposit.

This is really getting me down, I left the property after she told me she wanted to sell it and severed notice, of which the first time she did it was not valid according to the Housing and Homeless team in my town.

I got a council flat and am struggling financially, it has cost a lot more than I thought it would to move, I don't understand why she wont release the deposit. The house had faulty central heating which stopped working over the winter period and the wiring in the kitchen burnt out due to being never rewired and illegally wired in places according to the electrician. She sold another house before when it needed repairs and I wished I realised then. Also she is friend's with one of the neighbours who in a disputed with the neighbour who was trespassing on the property assaulted me [I got the police involved]. My landlady does not know where I live and I do not want her to for my own safety.


What do I do?:(:(:(

    And is it in England Wales or Scotland?

    If relevant, request release of the deposit from the scheme.

    If deposit scheme not relevant, have you written to the LL at the address "for the serving of notices" requesting the deposit within 5 days (less any deductions you agree with), and warning legal action will follow?

    England, and got a DPS [didn't get the details till the council told her I was to be given it], I've done a request online again [ I hope they don't pass on my new address to the landlady as I wont feel safe again].

    What are the reasons for the non release?
    Have you done anything apart from request its release. You may need to escalate it.
    Well life is harsh, hug me don't reject me.
  • If she wants to make deductions from your deposit she will have to enumerate them. Then, if you dispute any of them, she will have to justify how those figures are arrived at. She can't just pluck figures out of the air. DPS is a custodial scheme, which means that the landlady isn't physically in possession of your money, the DPS is, so the money will be returned to you by them.

    Was there a dual-signed check-in inventory at the start of your tenancy?
