Real Court cases and what happened next!!

I have been following the various threads on Parking. So far I have received a letter from Debt Recovery. I also know that parking firms are now taking some people to court - a new trend, but I haven't seen anything yet about what happened next. Recent Real court cases and their outcomes - are there any threads anywhere, I am curious to know?

    I don't think there has been any finished cases that have been all the way through the system yet. ( i stand to be corrected!)
    I think there have been some PPC no shows, some withdrawn cases and some default wins.

    There was a poster on here who had been into court against Mr Sobell (graham white). I think he won his case.

    As above there have been some older cases where th parking companys have tried court and usualy lost ( dont forget your toothbrush) or where the parking company has failed to turn up at court ( ie done a runner ) there are also a small amount of successes for the parking companys, which are often caused by the defendant ignoring everything ( ie the court papaers) or from a poor performance from the defandant.

    As for the recent rash of court papaers, as far as i know none have actualy gone to court yet, only the papaers have been issued. The protection of freedoms act has yet to be properly tested.

    It's suspected that the reason for this sudden rash of court papers is that the PPCs have realised that by sending them out they can frighten enough people into paying up. In other words, yet anther link in the threatogram chain.

    Also, Parking Eye have a new "legal eagle" who it seems is trying to make a name for herself and justifying her existence by sending out lots of court papers.

    I post as SchoolRunMum on pepipoo and you can see from the link in my answer there that everyone gets these same old rubbish letters and no-one has gone to Court recently that we are aware of.

    I and others have been writing defences for some new cases which have come up on Pepipoo in the past couple of months, many of them from CEL and some others from Parking Eye and UKCPS.

    Those which have got as far as the Allocation Questionnaire and been transferred to the Defendant's local court, have been given hearing dates in July / August, which may be a reflection of the extra burden the increase in PPC claims is putting on the Judicial system (i.e. the complete opposite of what the BPA claimed prior to POFA).

    This doesn't necessarily mean the hearings will go ahead; the Claimant has until 14 days before the court date to pay a hearing fee, otherwise the claim gets struck out.

    So quite a while to wait yet.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx.     Just out of interest,
    Is there a time limit if you are on this list or is it for ever.

    I noticed a couple of entries where deceased is next to the name.

    The first two entries under "O" are interesting
  • Thanks Bargepole. Would you say that the people who have been given court hearing dates are by and large people who have made themselves known to the PPC, either by appealing or writing to them. Just trying to figure out how they have been selected for prosecution.
