I paid NI got a tax rebate when i was appealing the Atos test, due to the income being lower, i guess i'll be paying it back though after winning my esa appeal.
I don't believe that NI and tax is deducted from benefits - was your tax rebate from tax paid on earned income prior to going on benefits?

I really don't care if you you don't beleive that as i know it's the truth, hence me getting a tax rebate when the level of income fell.

Taxable benefits are just that....taxable. If your income falls below a certain level and tax has been overpaid...you can reclaim it. You can also reclaim NI if that too has been overpaid...

I believe here is no mechanism for deducting income tax from benefit payments so did you pay the income tax by cheque?

Income Tax can be deducted at source from Incapacity Benefit.

If the customer is on I.S as well as a top up, then the higher amount of IB before tax is taking into account against the I.S.
