Monarch have refused to pay out claiming:
Our records show that upon arrival in Larnaca of the outbound flight, the aircraft scheduled to operate your flight developed a number one engine overspeed protection fault and was declared unserviceable for your flight. The fault would take engineers approximately thirty hours to rectify so in order to reduce the length of your delay, passengers on your flight were transferred to an alternative aircraft which was scheduled to operate a flight from Larnaca to Luton the day after you were originally due to travel.
NB: I WAS ACTUALLY TRAVELLING TO BIRMINGHAM???
Can I go to ABTA or small claims court or lodge an appeal?

After denial of your claim, issue 14 days notice of Court Action:
Centipede100 Template letter This is the 'Notice Before Action' letter (NBA or LBA)
Explanation of the legal process of NBA, 14 days notice before court claim.0 -

 ouch!!! I fail to see the use or helpfulness in that comment when you know nothing of my plight!0 -

You need to understand that the folk on here had to start and learn how to claim against the airlines from scratch, there is no book, there is no college course.
Having done that they have chosen to share the information on this board to enable others to learn and claim themselves.
They are not paid to do this, they are not full time and do have lives of their own. If anyone gets into the process and needs help on a soecific point they will help.
But they will not do it for you, that is your responsability to use the knowledge here to learn how to and do it. If you are unable too, a quick google will find some, fairly new, claims companies who you can pay to do it.0
