I take it you paid them a deposit?

Did you sign an order for the car? (i assume you did)

I would say you'll lose your deposit at very least. Assuming you signed an order, they could persue you for any loses on their part - for example if they had to sell the car for £3,000 less to get it sold, but i am not sure if they would do that or not.

Did you lose your job or something?
  • Hi yes i paid £250 deposit in Feb, i signed an order form, but 3 weeks ago i was taken into hospital lost income and due to this my business has suffered drastically with me being absent for 3 weeks plus my medical condition may mean i am unable to drive DVLA have to make a decision which may several weeks, the vehicle is due to arrive at Audi in the next few days and i may have to close my business due to ill health.

It does state on the order the monthly payments for pcp with audi finance too. i dont mind loosing the deposit as it is no fault of Audis

im up the creek without a paddle i fear

Have you explained all this to the sales manager face to face?

I suspect they are posturing at this point to try to 'force' you to complete the deal. I'm dont think they would pursue you for any loses.
  • i have spoken to my sales guy who i dealt with (who also said he is head of finance) over the phone, too poorly to go into the garage. he is just saying i am still liable to take the car

What car have you ordered? The could probably easily sell it to someone else, without suffering any losses.

Forget the he said she said, you will lose your deposit, it's not as if they won't be able to sell the car, £250 is a low deposit , think I had to pay £1k 8 years ago.
Your agreement becomes good when the car is delivered and you collect, you won't be the 1st or the last to have been in this situation.
Contact CAB for some further direction.

And name the dealership. I'm looking for a new motor and if there's a discount to be had. ;)

My understanding is that Audi finance is separate from dealer, you make the agreement with the dealer and then a separate agreement with the finance company and they pay the dealer.

I'm pretty sure (although not %100 that you signed the deal and are legally obliged to see it through) , but I would get in touch with the finance company (not the salesman) explain to them circumstances, also guessing it's a AUDI dealer, would also write to their head Office and also Audi themselves, surely nobody wins here if they force it onto you, you are possibly only going to default, then they have the hassle of chasing you up, Audi gets a bad rep from you and your friends & family because the way you've been unsympathetically treated

may also be a idea speaking to citizens advice, they could possibly help you here
