    If she was 89 I can't imagine him being between 18 and 35.

    Do check the tenancy can't be inherited- don't just take their word for it -if you can't find a copy then get them to provide a copy of the original (ie not a current tenancy ).

    If your MIL's tenancy was a secure tenancy then if the tenancy has not been passed on before (eg from MIL's husband to MIL) then the son can succeed to the tenancy if he has lived there for more than a year.

    However, many councils stipulate that if there are a certain number of bedrooms above what is needed then they would ask him to transfer elsewhere. Whether he would be able to move to another smaller council house/flat is dependant on the council.

    Whatever the outcome the local housing officer should be able to help and advise.
    thank you that is good advice, lm not sure if the tenancy was a joint one or not but father in law died around twenty five years ago

    So sorry to hear this. Locally you should have a branch of the Carers' Association (or something very similar). I would get in touch with them.
    As your b-i-l is of working age he will need to sort out his tenancy and register for work, as allowances etc. will stop. They should support him in doing this. It can be very hard for carers who are both bereaved and facing sudden changes. Most councils are helpful, but I wonder if he will even afford the rent, even if he could stay. He does need good advice.
    Good that he has you to help him through this.

    thank you l never thought about the carers association so l will tell him to get in touch, l feel sorry for him because his life is going to change so much now, all he has known since he was younger is looking after her so yes you are right about sudden changes on top of losing his mum, l can see it being very hard indeed

    I cant advise regarding the housing situation but wanted to send my condolences for your loss. Sorry to hear that your mother in law passed on. I hope she went peacefully. Thinking of you OP.

    thank you so much, she did go peacefully thank goodness, at 11.45 she was talking to her daughter then went to sleep and died half an hour later, l'm so pleased she went in her sleep and didnt have the struggle that so many of them have during their last hours, it really is something for us to be thankful for, she was a lovely person and we will miss her very much

    just to update everyone about my brother in law, thankfully they've transferred the tenancy into his name so he is allowed to stay, l'm so pleased for him as l think having to leave the house he was born in so soon after loosing his mum would have been awful, thanks to everyone who helped

    Is he reliant on housing benefit to pay for it? If so, won't he have financial problems with the two spare rooms?

    His Housing Benefit will be based on the rate for a one-bedroom property. He can ask them for help to transfer to smaller property or finance the difference between the contribution from HB and the full rent from his own resources. This could see any savings he has dwindling quite quickly.
