There is no legal right whatsoever to cancellation/return of an item bought instore, and no cooling-off period, except what the retailer may choose to offer you under their own returns policy. Why should there be? There is a cost to the retailer every time this happens ~(which is of course passed on to other customers), particularly with a handset, which once used, can can no longer be resold as new.
If you bought a new car in a showroom, would you expect to be able to take it back the next day for a full refund?

I'm afraid you are very wrong with this statement. A quick look on the CPW site for in store sales shows no refunds or exchanges on ALL the major networks except, (ironically in this situation) O2. :rotfl:
Though it does say the O2 returns excludes iPhones and upgrades. Is your new phone an iPhone or an upgrade?
I think a lot of people have become so used to the benefits of the DSR that when they don't get the same experience for an in-store transaction they think they are being done over by unscrupulous companies.0 -
At least the OP has admitted that it's not their right to return it.
The number of posts we see with "I know my rights", "I'm going to Watchdog", "I've got consumer rights", "I'm going to call Trading Standards" etc...0 -
Unfortunately this is often the hidden cost of the 3rd parties. They can afford to be cheaper because they don't have to bear the cost of returns.
Your offer to recompense them is reasonable but most companies wont have the systems in place to accept it.
