In the list for recovering charges and taking the bank to court there is no mention of a payment of £100 for the Allocation Questionaire.Is this a new fee? I had to pay mine 27/07/07, the day they suspended the cases.Should i have heared from the court by now?

HSBC didn't enter a defence for our court case which was due on 14th August. A stay was put on the court case. Should I be going down a different avenue with this now as they didn't enter a defence??

Did the bank ask for the stay or did your court just do it? Contact the court and appeal the decision.0 -
with regards to my claim. i think its a bit more than bank charges. as our first mortgage was with natwest, overdradft limit £500, now if my wages were messed up there wasnt enough money in the account natwest still took the mortgage payment with no or small charges as soon as we re-mortgaged with different lender thats when we started to get all the charges i see this as discrimination against us as we took our bussiness away from them. my partner is self employed and works outside and with the recent floods in the area could not work. so armed with all this do you think if we went to court and to be seen as a hardship case along with the discrimination of them to us the judge would see it through or would he hold back because of the test case and if the judge went trough with it do you think we stood a good chance ? could someone please answer as need some advice its all very confusing with this test case lark

hi can someone help me, not sure how to post a thread, new on here, anyway the problem is, started to reclaim bank charges from rbs on 10th june, 2 days before they were due to pay out to myself and my boyfriend, we both received letters from them saying that they had found a loophole and they are going to court because they feel the charges are lawfull, has this happened to anyone else? and if so, where do we stand? do we just have to wait??0

I had applied for my credit card statements to the Bank Of Scotland sending off my £10 cheque which was cashed. I eventually received the statments 76 days after first requesting them way beyond the 56 days that the Banks were hiding behind as to the period they were being allowed to respond. Of course the Court case conveniently arrived during the delay. I wrote to them on the 6th August stating that they had created a precedent (in my eyes anyway) by making a previous payment to me, I recieved a letter dated the 15th August which I would like to share with you.
I am sure you will appreciate that like other organisations we incur costs for administering your account for late/unpaid payment or overlimit situations. The Bank believes it is fair to pass these costs on to the accounts affected, rather than absorb them into other areas of our organisation, penalising all our other customers as a result.
HBOS clearly outlines our charging policy in the Terms and Conditions that apply to your account. In addition we are committed to complying with the Banking Code, which sets out standards of good banking practice for Banks and Building Societies follow when dealing with personal customers. As per HBOS policy we do not disclose a breakdown or information regarding the cost involved in administering our credit card accounts.In view of the above, I regret to advise I am unable to refund the charges in question as they were applied to your accouint as per your original agreement. I trust this clarifies the situation.
I was never a HBOS customer by choice, any agreement I had was with the BOS back in December 2001. I note that when it suits them they respond as
BOS from Dunfermline and also HBOS from Halifax. I intend pursuing this due to the 76 days it took them to respond to my request and the precedent they set when making a previous card settlement on behalf of Sainsburys Bank with me. They will have to disclose their information of costs breakdown when the Court case commences.0 -
Well, hubby in court tomorrow. No word from Barclays - they applied for a Stay, and we assume that they think it has been granted - it hasn't - the Court has said it was too close and they are going ahead with it. We fully expected to hear from Barclays with an offer, but he is going to go to court tomorrow - I assume that they just won't show, and therefore he wins by default. Anyway he is quite prepared with his bundle to go in front of the judge. What happens if they do show though? Should he just ask the pertinent question "please give me a full breakdown of these charges and why they are considered to be lawful". Should that work? We are not very legally minded. Also, does he request the judge to add the £120 court fee and the £100 allocation fee to be refunded.0
