(14) if the firm attempts to resolve a relevant charges complaint after the date of this direction (other than those described in condition 12(4)):
(a) the firm must not seek agreement from the complainant that the resolution is in full and final settlement of the matter;
I got this from the FSA website this is one of the conditions of the waiver.
You can read the full document here:

Hope this helps
Thanks for this!!
I'll be using FSA Direction 6.1 in my next letter to HSBC.. my judgement was given on 25th July and bank are refusing to pay out - but 6.1 clearly states that 'this direction takes affect on 26th July'. Woo hoo! :T0 -

Hi everyone, accepted an offer from Halifax via FOS. acceptance form was received by Halifax 01.08.2007, yet still awaiting funds. customer relations 08457 253519, are utterly useless, yet can't get to speak to anyone else but them. They keep quoting 4/6 weeks until I receive payment, but I need it now as I'm broke! would appreciate any advice on how to hurry them up, phone no's etc. many thanks.0

just keep phoning them, thats what i did and within 3 days it was in my bank account GOOD LUCK0

thanks spacemere, which dept did you phone? as customer relations are useless and are getting fed up of me calling every day.0

You could always write to them and tell them that they are causing you financial hardship by withholding the funds? Other than that, I guess you just need to be thankful that they are even paying up at all, considering how difficult it is for people in the process now to get their claims even looked at. Good luck though.0

Bank: LLoydsTSB
Amount Reclaimed: originally asked for £450
Amount they paid: £623
The story: Sent off both of Martins templates asking for £450 of bank charges to be refunded and received the obvious replies as per everyone elses stories on here. Went to MCOL and the bank acknowledged the claim. I was waiting for them to defend as I received a letter from their solicitors saying they would defend and I was'nt getting a penny (this was on a Friday). This was also after the announcement that the test case was going ahead and all claims were going to be suspended pending the outcome of the test case. I had thought that I was not going to get anything but then on Tuesday the following week I had an offer of £623 (interest, MCOL charge). Signed the enclosed papers and got paid today (3 weeks after returning the paperwork).
Martin, thanks very much !
Today I received papers from the court explaining that the bank was going to defend the claim - 4 weeks after they settled ? Don't you love big corporations ? Absolutely useless.0
