Story so far
Is letter sent 13th April
Decided to wait the 8 wks, even tho did send letter threatening court
8th June - deadline - no resolution
Was told by FOUR different people at the call centre an "OFFER" letter was in the post, was told this on 8Th, 11th & 12th (i rang twice) as no letter received. I emailed the bank, the bank replied 15th via e mail stating they wouldn't be paying out!! Received the decline letter today, it was dated the 13th!! So they are a bunch of liars! I'm fuming :mad: :mad: :mad: I really don;t want to go thro court myself, as a full time stressful job and other issues going on, so has anyone out there used a Soliciters they could recommend to me?

I simply sent two letters to HSBC and waited out the eight weeks. I got the letter in the post yesterday offering me £820 or 85% - I've tried to bargain them upwards on the phone but was told to write a letter. I am not sure how much longer I'd have to wait after sending the letter so I might just accept the money now - it's money I didn't have yesterday! However, if anyone has managed to barter HSBC upwards from their initial offer without going to court I'd appreciate your advice!Got £820 back from HSBC! Now entering comps like mad with the hope of winning a nice long holiday....0 -
Why don't you just go through the FOS. They have just taken on my case and their service is free. They will negotiate with the bank on your behalf. Reading through the success stories, they have had a fair bit of success. I live in Scotland and it was the best route for me to take, as my claim is way over the small claims limit of £750.00

Started the claim in Feb 07, denied twice and filed MCOL. Had the acknowledgement and they had until 11th June to file a defence.
Filed a defence on 11th june, basically saying the admited I had an account with them, that any charges debited were debited in accordance with the contract made between the defendant and the claimant, have been regularly advised of any charges (which is untrue, only once a month on statement), and that they deny that the claimant is entitled to any repayment.
I emailed the solicitor to say I was willing to settle out of court, which they have declined. I am now waiting for the papers and a court date! HELP!!!!
I am getting scared now that I will have to go all the way, or is this another delay tactic?0 -

The story: I went to court and won! has this happened to anyone else?
I've been waiting for the Abbey to settle since I first started my claim in January 07. They kept playing for time, offered me half, then played for time again. Court date was set for 4th June but I thought they'd pay up before it got that far but they didn't. Right up to the post man coming on the 4th, I thought they would pay up - but no! Imagine my horror when I realised that I definitely would have to attend court. Thanksfully I had all the paper work ready just in case. I went for my appointment at the County Court and guess what! The Abbey didn't turn up. No surprise there. So the judge awarded in my favour!! The Abbey have to pay back all the charges plus the court fee plus travel expenses.
For those of you who are still trying, don't give up - don't be worried about going to court, it was scary and I felt unqualified to defend myself but I did it and it felt great! The judge seemed quite stern at first but he admitted that he was playing devil's advocate and was quite nice in the end. He even put my travel expenses on the bill that will be going to the Abbey. If anyone wants to know the sort of things I was asked, just fire away. I'm on top of the world tonight and dead proud of myself for not giving up.

Can someone help me please. I have recived a letter from Nothhampton Count Court saying the case has been refered to Wakefield Court (my local court). The date has been set for 21 August 2007. I have been asked to deliver to each party and court office copies of all documents 14 days before the court date.
My question is what do i need to include in my court bundle? Just the letters i wrote to them or something extra?
I also found some extra charges which i was subject to after i had made a claim on line. Should i add these as well or not??0 -

I received full settlement from HSBC but the Alliance & Leicester are fighting me all the way. I have just received a court date for 5 July, can you give me some advice on what they may ask in court?

Hi everyone
I'm in a right pickle because I'm not sure what my next step is and don't want to do anything wrong in case I jeopardise my chances.
Here is my story with HSBC:
31st March 07 - Wrote to Canada Sq requesting list of charges
12th May 07 - no response so rang Service Quality Team - no record of my letter so they used this day as the start of the 40 day process
2nd June 07 - through this site, discovered that I could view statements on internet banking site do did just that
2nd June 07 - sent letter to Service Quality Team (SQT) with full schedule of charges, asking for £3,212 (inc interest) to be repaid
6th June 07 - received letter from SQT saying, "looking into matters", together with leaflet that says they have eight weeks to respond.
I've been with this bank for 25 years (my fault, I know), but I've had enough. They have been charging me £100 "notified fee" for going over my overdraft for just a few pounds. I'm fuming and as soon as I get my money, I'm leaving them.
The dilemma I have is should I wait the eight weeks for them to respond or should I take the MCOL route? I don't want to wait eight weeks so can I go straigt to MCOL? I hope that somebody out there will be able to give me your opinion. Thanks so much.0
