    Yes you can still reclaim the charges and just send the Subject Access Request under the Data protection Act as usual giving your account number and name and address and date of birth for their information. You dont need to pay a fee to HSBC as their statements are usually available online but they wont be available to you since your account is closed. They will be sent to you though. From there on claim in the usual way, there is no difference. Good luck :)

    Can someone shed some light on this, been claiming off hsbc through money claim online, bank had till last tues to enter defence they didnt so judgement awarded and sent to bank been trying to contact bank for a week now to see when money would be paid passed me around different departments and also there solicitors (d and g) no joy, been back on money claim website today, judgement has been halted rang them they say judge has suspended judgement as defence was put in but not put on system in time i asked whos fault was it that it wasnt put on they say no ones!!!! funny thing is it is showing now that defence was entered before they even acknowleged the claim, how can that be? does this sound dodgy to anyone else?, sorry abot lack of punctuation im to angry to bother:mad:
  • Hi Just a received a letter from bank of scotland saying charges are fair etc.Phoned them up to re evaluate my claim was told this could take 8 weeks is it true:mad:
  • i am up to the stage now where i have sent in MCOl and they have sent me a letter stating that they would like to defend - what happens now??

    Hi Jayneo,

    I wouldn't say I am 'clued-up', more that I am reasonably informed because I have spent a lot of time over the past few months reading the threads both on here and the CAG website. There are plenty on here who are far more knowledgebale than me on these boards. But I would still be happy to swap stories and offer moral support.

    I sent off all my 'directions' papers both to the court AND D&G Solictors (who First Direct use) yesterday. I have also put my court bundle together and that is ready to go (it's bloody HUUUGE !!).

    Funny thing is, though the bank are defending and though I have a court date, I have yet to see what their defence is. Hopefully, the paperwork I sent through yesterday will remedy that. Though I am also hoping that when the Judge reads it that he will strike out their defence as an abuse of process. I cited more than 50 examples of First Direct settling claims before they got to court after stating their intention to defend. I also pointed out that they have NEVER set a foot in court to defend any claim !!

    Alan,

    It'll get transferred to your local county court now to be processed. You won't be able to do anything else on MCOL.

    This is where the fun/worry (depending on your personality) starts. You'll get further instructions from the Judge at your local county court as to what he expects from you and from the bank. Depending on how busy the court is, you may even get a court date.

    Sit tight. You are on the home straight now. You'll soon be posting your win on the 'Success' thread !!

    Hi jen jen,
    I was in excactly the same situation as you.
    I have today forwarded all my details to the FOS as I received a letter yesterday declining my request for refund after 8 weeks. ( excactly to the day) I have also asked the FOS to try and get my default removed, as if it hadn't been for the charges, my account wouldn't have been in the position it was. What I found funny was that the Bank of Scotland had investigated my account for 8 weeks, yet they never picked up that it has been closed for a year!!:rotfl:

    Sorry if this has been covered elsewhere or is the wrong place to post - I'm in the early stages of this process and my husband and I received our bank statements this week - however Natwest have only sent him statements going back to Oct 02 and my bank (RBS) have sent mine going back to July 03. I thought they had to send them for the last 6 years?

    I have just recieved a letter from Barclaycard telling me that without any admission of guilt and a gesture of goodwill they are prepared to credit my account withh £144.00 which is the difference between the old account charges and there new charge of £12.00. According to this letter they reduced its fee to £12.00 following the publication of the statement by OFT. I am actually claiming for £360.00 does anyone know if it would be worth writing or phoning to say l don`t accept their offer as l closed my account in April 06 and they didnt reduce their charges til Aug 06. I recieved this letter after sending only the first letter to BC does it bode well , has anyone else recieved the same. it`s a Littlewoods credit card but run by Barclaycard. It also stated that if the account was closed to call them and they will put the money in my bank account. Would it be better to phone and say no or write and have a copy letter for the court bundle
  • Thanks Twinkly for that info it has cleared my head a bit. I know i wont get them to disclose their figures but its worth asking and showing them im not going to roll over.
