Set off on time but then turned back - still a valid claim?

Hi
We were on a flight to Sri Lanka in 2008. We took off pretty much on time, but after about 1/2 hour in the air the pilot advised that there was a technical issue and we would have to return to Gatwick. They put us up in a hotel and we finally set off the following day - 24 hours later. Would we still be able to claim? The flight delay website shows that the flight was only delayed by about 15 mins originally.
Yours hopefully
Kat

    Still a valid claim.
  • I was on your flight too! I have tried to claim compensation and appealed against their initial refusal. They refused again with a final letter and let me know that I could seek 3rd party advice! They refused on the basis that it was over 2 years ago.

I have submitted all my details to claims4flights who have taken this case on. I haven't got the paperwork to hand but I believe they take 20% of compensation if settled out of court and 30% if it goes to court.

I wanted to do this myself but didn't have the confidence or know how to take them to court myself. 70% or 80% of something is better than 100% of nothing!

    It's arrival time that matters.

Hi Debbie - mine has moved on slightly. After First Choice refused me twice, I then sent the claim onto the CAA. They have responded saying that in light of new information we can now claim for up to 6 years so have passed it back to Thomson / FC for them to re assess. However they did say that there may have been circumstances beyond their control for the delay, and they will not pay out the full amount for this, but maybe would pay a reduced amount. So its conflicting information being given out by all parties.
Let me know how you get on with the Claims people
    Thanks

I've never known the CAA say either of these things before - can you quote their letter, for precision?
