Thomson Reject Delay Claim

Tried to claim compensation off Thomson for 23 hour delay for our flight from Manchester to Cuba, Had letter telling us as it was a fuel leak we are not entitled to compensation. Thomson wrote...
'The flight was a reactionary delay due to a fuel leak on its previous flight. As a fuel leak can not be determined during our pre-flight check this would be classed as Extraordinary Circumstances, Therefore we are unable to offer compensation .
Can anybody advise me on what to do next. Thnx

Not EC, nor was it your flight.
'unfortunately' you have to comply with pre-action protocols, which means you have to write back with a NBA letter (template in the FAQ's) giving them 14 days to settle or else you'll go to court.
After that, it's court, or hand your claim over to a no win no fee firm.0 -

Notice Before Action - normally a letter (proof of posting or recorded) sent 14 days prior to you initiating legal action. This should put the airline on Notice that you WILL commence a claim (Small Claims procedure) and should not be seen as being a threat that you will possibly submit a claim.
