can i go bankrupt as i cant see a way out

    Right, Halifax will close the account THE MINUTE they get a whiff of BR. You need to open a Co Op Cashminder account & get all the cash from the Halifax to the Co Op asap. The Cashminder is a basic bank account so it needs to be included in your BR paperwork, but when you speak to the OR's office tell her its a basic account & being used for day to day living expenses. It will then usually stay open for your DD's & any wages. I told them this when they phoned me after court & they didn't even question it, so its now my main bank account & has not been disrupted or frozen at all.

    If you don't want to use the Co Op then you can use Barclays. If Barclays are a creditor then you can open the account after you declare so any amounts are not offset, but it does not include online banking (which the Co Op does) so for those of us who manage our monthly outgoings online the Barclays is not ideal.

    ok think first things to get the cashminder account opened up then and get dd paid out of it and wage paid in. will it matter if i have small saving when and if the BR happens i.e £300 or so ?

    i have been to see a debt advisor as pointed out on here face to face, she advised ignore cards as ive sent a prove it letter i got off here and 3 weeks later thay have chose to ignore...... my main worry is the house i cant sell..she advised me to get onto santander and ask about voluntary repocession so i have done that and await their pack they said they would send me. via my union in work i spoke to someone today about debt who advised dont worry. save up a little each month until you have the £640 to declare yourself bankrupt and it will sort itself out. sounds simple put that way but i doubt it. i msure its a long drawn process making court appearances etc....fingers crossed
  • Crowsman, My union gave me a grant , in the form of a cheque to pay my BR fees, which are £700, unless you get a reduction through circumstances. My advice , a newbie BR this week. Get a calm hour in your house, a notepad, pen & a coffee & call a free phone number debt advice company for advice.
    They'll give you a ref number , and after speaking send out details of what you've discussed , leaflets & stuff.
    You'll need to have taken advice before the judge will grant you BR.
    put the ref number on your forms, along with the company name , step change etc....
    But most of all, get the right advice , start to think its the first step to a long journey to eventual peace of mind

    ok. as well as going going wrong way i.e going into month 7 of me not paying mortgage altho ive an offer on it of 130k with 150k owed. waiting on santander to advise me on that one as they checking to see if their litagation team will accept an under value sale.
    i also have debt collector pestering me at my door about credit cards in my name yet i am not aware off. told him ive written to the westcot company asking for proof by way of copy agreement statements charges fees etc. 2 months im waiting and nothing. and this guys cheeky and rude and a pest.

    is it really as simple as paying £640 to declare myself bankrupt and setting up a new account to pay my direct debits and have my wage go in.
    will it all go away then as its affecting my life so much and i cant cope with it

    Yes....................and no!

    Since it appears BR is what you're aiming for, have you already got your basic bank account up & running?

    This needs sorting first. [as per our advice?}

    Have you written to Westcot to inform them you will only deal with them by post? [They should then cease the doorstepping]. Fermi I think has a format letter in this respect?

    In any event, ignore the doorsteppers. Nothing they can do about it.

    Organise somewhere nice to live, before popping into Court for a BR petition.


    Of course, once the petition is granted, then your financial life is in the hands of the Official Receiver.

    This can be equally challenging.

    But, this is what we are here for?

    ok i havent got the basic bank account yet as i really thought the house was gone. i will do that asap and get my wage going into it and the dds paid out. this will only leave me with my halifax account which i will clear and make sure its not overdrawn....
    wescot ive sent the prove it letter from on here. theyve ignored for 2 months and have now passed to credit security limted. it is CSL that has sent the gut to my door. i will send them the same prove it letter and ask for the collector to stop harassing me as its not up to me to prove it as he says...... i am told theres another letter you can send since theyve ignored my prove it letter from 2 months ago but i cant find a link for it on here. hopefully someone can help.
    i have no assets other than the house. i am moving next week with my new partner and its all in her name same as the car. ive nothing in my name just a few hundred in saving in my halifax account ive saved for my kids school fees etc. i will take that out and put either im my partners account or the new basic one. after all that if i pay the £640 can i get back to living again worry free ?
