can i go bankrupt as i cant see a way out

Was this a joint IVA? Or was it a joint credit card. I'm a bit confused as to how if it was just your debt how that could be put in her IVA.?.?
With regards to the house if it is in joint names and you go bankrupt then the mortgage company will persue her for the debt. If the mortgage company reposes and sell the house for less than the mortgage then the shortfall will be passed over to her and she will be chased for payment.
If the Mint card was what you originally had in 2002 and its soley in your name then I'm afraid you are liable even if it was her using the card. You may be able to report her to the police for fraud of some kind but doubt you would get anywhere.
If you have any other debts be it loans or credit cards catalogues that you are currently using then they will also be put into the bankruptcy.
You really need to speak to one of the debt charities or CAB as you need to have been given advice from one of them before proceeding with bankruptcy.0 -
yes iva was joint. i had what i thought was the mint card at around 4 or 5 k. the rest was all hers mounting to 50k. mint was in my name and she paid full iva as it was also her debt on it at time.
got amother letter yesterday from a 3rd card now monument only couple hundred but again must be hers.
all coming out of the woodwork now the iva was terminated in sep 2012 as she stopped paying it after we split.
ive spoke to a solicitor and she says police could be contacted for fraud but probably wont be intrested as a domestic or matrimonial issue at time.
also it would help seeing my kids. she stopped that and again courts dont care about fathers rights. been fighting that 3 years and best i get is twice a week with the ten year old and the now 14 year old posioned against her daddy. so if i get police onto their mum even if were intrested it would make it worse.
im screwed. no way out....
cant move on..... this is all 2008 2009. do i ignore way she did and hope it goes away after 6 years0 -

I would say its probably not a good idea to ignore it. As for contact with your children that's a separate issue. Do you have a contact order in place, if not I would recommend getting one.
As for the debts if you can't afford to pay them then bankruptcy may be your only option. Then if anymore come out of the woodwork they would be included. Your ex wife would be chased for the mortgage payments if she couldn't pay the house would be repossessed and then sold and the short fall would be on her head. You may take some pleasure in that, I know I probably would.
Anyway burying your head in the sand isn't going to fix this, speak to one of the debt charities and get your head together. You don't want them adding CCJ's to your credit file and constantly chasing you for the debt. Bankrupt y will have it over with and then you can get on with fighting for your kids.
BTW the courts take a very dim view to parents who poison their kids minds towards their other parents. A case in Canada recently saw custody being moved from the mother to the father because she had constantly lied and put down their father. If you want to see your kids fight, they will not thank you for giving up on them. Good luck.0 -
thanks guys. moving into old home isnt an option as ive a new partner now and we live miles away and work miles away and she wouldnt want to live in it me neither as a lot of bad rumours were put arounfd the area about me. women and inlaws very bitter and a lot of lies told. kids is a seperate issue yes and have all the orders in place. i can assure you courts take the mothers side. fathers have little rights when it comes to court social workers who are liars and a disgrace....
anyhows
another one out of the woodwork today , a year ago a company chased me for another card monument. i explained all this and thought a year later its gone. today another company seems to have taken this on SRJ DEBT. not gona go through it all again with them.
getting no were with these debt companies and the card companied dont want to know.
bankruptcy seems the only option.
what is best way to do this. im in a union in work and rang them and they says it would cost me £700 to do it.
am i better waiting until court proceddings with the house then declare myself bankrupt0 -

got home last night to a solicitors letter from NELSON GUEST on behalf of westcott.
ten days to pay these 2 card debts i dont know about or further action be taken ???
16k i dont no about.
is this a proper solicitor or another bully tactic from westcott
what do i do
cant wait to move in 8 weeks maybe thaty will get rid of threats.......tho scared i may miss a court summonce and get arrested or somthin daft over this0 -
Nelson Guest are a solicitors so they probably are legitimate. They may be seeking a CCJ or put a charge on your house or make you bankrupt.
Have you spoke to one of the debt charties yet? I dont think moving house is going to get rid of these, as soon as you register on the electoral roll they will be able to find you. And I think its going to cause more trouble in the long run.
Sorry to say this but I think you need to man up and deal with it. I know its stressful but you need to get this sorted.0 -
yes i have but im told it will cost me £640 to be made bankrupt.
with all due respect man up you say, this is fraud. 16k of debt on cards in my name by my ex wife.
i dont think man up is the correct wording.0 -
and house is for sale and if sells will just cover fees if lucky. theres no money in it. almost into negative equity.
i just want a clean start as ive done no wrong here0
