Private Rent Problems

Hi

me and my partner are currently renting a 1 bed house but we are planning on moving out into a bigger place, the problem is when we moved in we paid a £400 bond to the landlord (to our knowledge it wasnt put in a bond scheme), every month when the rent is paid we got a reciept but the landlord is saying we owe him rent even tho he is not willing to provide us with a rent statement to prove what he is saying. We have misplaced some of the reciepts for rent so we are unable to prove that we have paid every month upto date.

Can anyone help with advice on where we stand in regards to getting the bond back? (We do have the reciept for the bond that was paid).

  • yes it has all been dealt with cash :( so we havnt got any bank statements to prove it either

    we have been asking the landlord for about a year for a rent statement and he keeps saying yes he will sort it out but we are still waiting and we are wondering if it is because he is trying to pull one over on us trying to get us to pay extra rent that we dont owe??

    Did you get a reciept for the bond? Thats the main one...

    Have you been withdrawing the cash from your own banks at similar times each month to pay? It would be at least some prove that the money was taken for the LL. If you have the most two recent reciepts I would of thought that would cover you as he can hardly take you to court for a 'missed' payment when you have your bank statements to prove cash was withdrawn from that month & recent reciepts to say you have paid.

    If you don't have a bond reciept Im afaird its going to be very hard to get it back... if you have one then it might go to court but it wouldn't cost alot and you alot (and he would pay those costs anyway)

    Only other thing I could suggest is not paying the last months rent...getting your bond back and saying why if he is being a twit about it but since your paying cash I suppose this would make things awkard for you...

  • yes we have got the bond reciept and good thinking lol i didnt think of that with the bank, all the money goes in and out of my partners accounts so we shud be able to prove it that way.

    Also another quick question do you know how much notice you have got to give on a periodic tenancy agreement?

    Ugh tbh I am not sure if 'periodic tenancy agreement' is differnert from a normal contract?

    Usally you have a fixed monthly contract I.e 12 months...then it moves to rolling.

    After its on a rolling contract you have to give a months notice *usally* our contract was 2 months notice but ours isnt common. Have you still got your contract to check?

  • yeah its a rolling tenancy and we looked in the tenancy agreement but it doesnt say ours is a little wierd, it says that we cant use a washing machine or have music on its crazy and makes no sense to me whatsoever. We have read on a few websites that you have to give 2 months notice we just arent sure as we will be signing the tenancy agreement on the 25th of this month :S so we aren't sure when to hand our notice in to the LL

    If the contract doesnt actally state how much notice to give then one month will be fine. Its the standard notice period...but you usally have to give it on the start of your contract (So if you signed the contract on the 20th you would give notice on the 19th/20th and pay that last month)

  • ok thanks so we sign the new TA on 25th April and give notice to quit on current house on 24th/25th? so we will have both properties for a month?

    What date did you sign your contract with LL and move in on?

    Edit: I wasnt very clear with my last post its not the start of your new contract its the date you started your old one that you need to give notice from.

    Kayalana you've got this answer about notice wrong on another thread. Please make sure you understand the law before continuing to advise others incorrectly.

    OP, you need to read this thread:

    You can give the notice whenever you like but it must be served (i.e. received) to give one month's notice to coincide with the end of a tenancy period.

    A tenancy period is often, but not necessarily, linked to the date you pay rent. It starts on the day after the fixed period of the tenancy expired, and ends a month later. i.e. if the fixed period of the tenancy ran out on 5th March, then the tenancy periods run from 6th - 5th. Notice must be served by the 5th of one month in order for the notice to expire by the 5th of the following month.

    You can't just give one month's notice from any date in the period.

    OP, what was the date you started the tenancy where you are living now? The dates for your tenancy in your new place are irrelevant in determining the existing tenancy.
