    You can give the notice whenever you like but it must be served (i.e. received) to give one month's notice to coincide with the end of a tenancy period.

    A tenancy period is often, but not necessarily, linked to the date you pay rent. It starts on the day after the fixed period of the tenancy expired, and ends a month later. i.e. if the fixed period of the tenancy ran out on 5th March, then the tenancy periods run from 6th - 5th. Notice must be served by the 5th of one month in order for the notice to expire by the 5th of the following month.

    You can't just give one month's notice from any date in the period.

    OP, what was the date you started the tenancy where you are living now? The dates for your tenancy in your new place are irrelevant in determining the existing tenancy.

    I did say that its when the rent was paid on another thread but thats only because my rent was inline with my agreement and I belive my advice on this thread is sound as I have only mentioned the date they signed the contract...which would be the same date the fixed tenancy ended.

    I don't want to get into an arguement but I fail to see how I have advised wrongly in this thread?

    Kayalana, to be honest I agree you may wish to slow down the advice giving. I can't tell if you have got it right or wrong because I can't even understand what you are saying.

    If you don't yet know terms like 'statutory periodic tenancy' then you need to step back for a bit. Not trying to be rude, am sure your intentions are good.

    OP, please answer the following:

    What country are you in (England, Scotland?)

    When was the start date of your tenancy? NOT when you pay rent, but when each rental period starts.

    Have you checked with the three schemes to make sure the deposit is not registered?

    If the deposit is not protected and is supposed to be then your strongest card will be suing the LL for this. Or using the threat to achieve an exit with minimum fuss.

    Will post more detail tomorrow (it's late and i start work early) but I am sure other posters will be along even before then.
