Does anyone know if it's illegal to sell details?

Does anyone know if it's illegal to sell peoples details I was told because I'm not on the telephone preference service they can sell my details.They said because I've ticked a box aswell they can sell my details.:mad:

    Your details can - and will be - sold. By many companies, to many other companies. For telephone calls and mail through the posst.

    Loads of companies do it.

    There are "get out" tick boxes with most things, somewhere, although they're usually written in double negatives so you're not sure what they're saying.

    If you are filling out forms online or by post, or contacting companies by phone they should ask you about permissions for future contact and whether they will share your details.

    You may have to tick or untick a box.

    If you are getting unsolicitated calls find out who it is and ask them to remove your details.

    If it's a UK company they are obliged to do so (although it could take a little while if they hold several records of your details). There can be financial penalties for companies who fail to comply with this.

    Overseas calls are not so regulated so are harder to stop.

    The first thing to do is register with TPS

    It's easy and free. Again it may take a few weeks to take affect but you should see a reduction in calls.

    It may not immediately stop calls from companies you have previously given permission to contact you but you can then tell them to remove your details and that you are TPS registered.

    I asked them 2 weeks ago when they phoned who it was that sold my details.I asked for address and phone number and the man on phone said he will take me off their list.Then I phoned company who sold my details still in process getting it sorted so can't say much just that he is finding out where my details came from. I never tick boxes and always read terms and conditions.I'm not joining tps can block calls on my mobile once I have it all sorted I'm blocking them.

    Still would like to know if it's illegal ?

    If your permission hasn't been given it contravenes the DPA. Chances are though you've given your permission by default without realising. That's not illegal but it should be, IMO.

    Permission should be deemed to have not been given unless directly expressed, i.e. you have to opt in, not out.

    Also remember that TPS are a toothless waste of space who seem intent on doing their utmost to avoid taking action against anyone.

    Sometimes the tick boxes are put around the other way to trick you.

    Instead of ticking to NOT be put on a mailing list, they say please leave unticked to be added to our mailing list.

    I can't recall coming across ANY such instance where a little bit of logical thought can't resolve the meaning. Yes they may try to word things to trick people, but if you have any knowledge of the English language (to GCSE level) then you shouldn't be caught out. :)

    They rely on people not reading though, it's easy to either un-tick or tick a box out of habit, nothing to do with not understanding what's written at all.
