It depends what they book, some tour operators require them to keep records for two years, others have no date. If everything is paper based, most agents will remove the details a year after travel unless there was a problem that was on going. If you are hoping they have kept details of flight numbers from 6 years ago, I think you will have no chance at all. Have you asked them already or are you hoping they 'must' have kept the details?
  • Thanks for the reply. Yes I booked a Thomas Cook holiday with Co Op Travel 4 years ago but they say they only keep records on computer for 3 years. I just find it strange that travel agents only have to keep their records 3 years when airlines have to keep them 6 years.

Hi calabash48. Even though you booked with co-op travel can you not find out details of the flight you were on from flightstats by using the date, destination and airline and then make a claim?

Your claim will be with the airline anyway and not the travel agent and airlines have to keep passenger manifests for longer than the travel agents I believe. I booked my flight with Thomas Cook but did not have any details (See my "Gutted" post). I found the flight number using flightstats, got a statement from my bank showing the payment that was made for the flight and have emailed the hotel I stayed in for confirmation. I am also gradually amassing lots of other evidence to show on the balance of probabilities that I travelled with TC.

I am prepared to go to court and the burden of proof will be with TC to prove I didn't fly on the delayed flight, not for me to prove that I did. It's a hurdle you have to get over before you even start looking at extraordinary circumstances etc. but given what's at stake it's worth it IMHO.

AFAIA Customs and Excise (VAT) requirements are for 6 years of paperwork to be kept.
