Selling My Annexe
Hi,
I have recently purchased this house with a planning permission for a self contained Annexe since 1985. I have renovated the house and Annexe to make everything brand new.
My only problem is that I have spent too much and now would like to recover the cost by selling the Annexe. My Lender has agreed to separate the Annexe from the main house on the land registry documents.
I would like to know if I can sell the Annexe (it is attached to the left side of the house, single story and self contained with it's own parking and garden at the back) after my land registry separates and do I need to pay some tax? It will be sold for about £100K-£120K?

The problem was never with your lender, it was with the local planning dept. You will need planning permission and it probably is going to be very difficult to get granted.

You can - once you've got the proper PP and separated the services and done the deeds etc.
But it's a limited market of people who want to buy that type of place. Plenty of renters, but very limited number of buyers as they tend to be small and disproportionately priced compared to more conventional properties locally. I've seen a few and they've always been about 20% higher in price than a comparable property as I think the owners tend to have an inflated idea of the desirability of living in somebody's "extra bit".0 -
Hasn't planning permission from 1985 expired? Did you get building regs approval and certificates? Does it have its own gas/ electric/ water supply and is it now registered for council tax?Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

I think you will needed to be guided by a solicitor on this.
My thoughts are:
Are there any restrictions on the planning permission documents?
Is the annex separate as regards council tax?
Up to now, have you ever used the annex as part of your main residence? I know you say it is self contained but does it have its own front door, own number/name, totally separate utilities?
You may need to pay Capital Gains Tax if you cannot prove that the annex has been part of your primary residence.0 -
The vast majority of planning permissions for annexes were granted with the proviso that the annex cannot be sold separately from the main house.
If as a previous poster suggested the annex was built without pp or building regs approval then any potential buyer's solicitor would pick up on this and that would make a sale difficult.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
