Ruflonger and Stoney - what date did you first give notice to cancel?
9 May is the date the price change came into effect.
I first emailed T-Mobile to cancel on the 15th April..
I've also just received this from CISAS: CISAS would like to recall the message, "Case Ref: xxxxxxxxx stoney73 v T-Mobile (UK) Limited"...
Any ideas?0 -

I still don't understand why the adjudicator's ruled that your termination fees be reduced to 50%... the findings don't explain it either...0 -

Honestly no idea, I've emailed now asking for clarification.....Not sure how I don't have a case but have got 50% off early termination charges.....0 -
Unless I'm reading it wrong, the adjudicator in Stoney's case made a recommendation (that he made quite clear was not binding on either party) that the ETF be reduced by 50%, although this seems to have been a gesture as he didn't explain why.
Remains to be seen whether T-Mobile go along with it.0 -
So your case is similar to d123's, in that you gave notice before 16 April, and I assume TM submitted the same defence (d123 posted the defence a few pages back).

I have started the process of terminating the contract however I am being quoted a higher figure for termination than appeared in the CASIS document. It stated there that the charge would be £x doing down on a daily basis but it has gone up from this figure. So I have complained and asked someone to justify why this is the case and why I am being charge for requesting the PAC code.
I haven't the time to go down the SCC route which is partly what imagine EE where banking on.0 -

Will be interesting to see if certain adjudicators swing certain ways with this.
I was excited / positive before.... much less so now, even if I did use d123's rebuttal to the T-Mobile defence :S

I have spoken to CISAS and basically the decision is final. I stated that I was aware that other decisions had found in favour of the claim against the EE and was told that each claim was viewed on its own merits and the argument and supporting document my not of been as strong as the other applicants. I have no choice but to accept the decision.

Either the relevant RPI rate is 3.2%, or it's not.
Either TM have breached the t&c's, or they haven't.
And why should consumers be expected to argue their case like lawyers!! :mad:0 -

I did, couple of paragraphs worth, and referred to it quite a few times.0
