Bank Charges case upheld

Whilst this judgement is a bit of a setback for all of us still in the process of reclaiming our charges, we should not get unduly worried about this. The court ruling is not binding and we should all still proceed with out claims against the banks.
It is only a matter of time before the banks start biting back at what has become a mass consumer revolt. "I'm Just A Demin Boy"

Looks like the Consumer Action Group site has crashed with all the people trying to find out info.
Was this guy unlucky that Lloyds chose to defend his claim, or maybe they spotted an error in the documents he submitted.
It seems strange that they challenged him, but on the same day chose to not enter a defence against other claims

this is a PR exercise for Lloyds TSB
All DJ judgments are not binding (but can be persuasive authority) on their fellow judges.
THIS IS NOT the first case that has come before the court. Many have been adjudicated upon and the banks have had to pay a significant amount of claimants. the overwhelming majority have been decided in the claimant's favour but unfortunately you can come across the odd district judge who wants to see an end to these types of claim.
i am a solicitor who has also been to court on numerous occasions and have been equally baffled with my opponent at what a district judge determines. however, most are fair minded and will ensure that cases are dealt with fairly.
this is not an end to bank claims, but is very effective PR by the bank.

I am not worried, after all we dont have any indication on how the man fought his case and if the judge was having an off day. A service fee again is the issue. Are not all service fees technically penalties, after all you did not ask the bank to take that service for you, the did it themselves and didnt even inform you of such. How can a judge believe these are service fees?0

Plus thinking about it Sexyboy has his screws in the right place. Think the whole reasopn we are all claiming is because many have won, even those in court, you cant let one case get you worried, and actually, why would losing £120 (court fees) worry me? when you have the chance to get justice?0

It's a shame that an otherwise interesting thread has to be spoiled by a silly comment. This thread is a discussion about whether a decision made by a DJ should be a worry to the many people still going through the system to reclaim bank charges.
If you have specific information against the judge then I suggest you take it to the law society, otherwise I would be careful about making a libellous statement on a popular and well visited website such as this.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
