Bank Charges case upheld

Interesting story on the BBC website about the Lloyd TSB case:
http://news.bbc.co.uk/1/hi/business/6658369.stm
May all have been one big mucking fuddle by the banks lawyers and Lloyds leading to their winning in court.
Definately worth a read.0 -
Unfortunately, not everyone is as fiscally astute as you are.
The reason I want my charges back is the amount of the charge. Charging £35 for a service which costs ~£4.50 is a rip-off in my eyes.
If they had charged me what it actually costs them - I wouldn't be taking them to court.
Lots of others on here missing the point as well...........
I haven't missed the point. Presumably your bank publishes its fees and you had every opportunity to peruse those fees before you did what you did?0 -
Tozer is there not a soup kitchen opening soon that you can go and work in now. My heart bleeds. any one who cares to read your previous posts today will see you as a negitive, scare monger, probably bank sympathiser , who ultimately will put many people off claiming their money back. Who ever you have helped in the past, (and no doubt brag about on a daily basis to your 275 an hour chums) you seem to be destroying that good will now.
And by the way, you are the one who got personal first. I was merely having a discussion. I only earn 17 per hour. Does that make me unqualified to argue with you. Your childish sentiment ie stoping your 'charity work' on this site because some one disagreed with you, speaks volume. good luck in your career.
No you didn't disagree with me - you spouted things which are utterly wrong. Thousands of judgments? Rubbish.
Oh, and it is pretty dense to think that I get PAID £275 per hour! That's how much I charge. I have an employer that takes it.
Not asking for sympathy - what I am asking for is that you keep inverted snobbery to yourself and actually acknowledge facts when you see them - even if you find them unpopular. Certainly don't need your wishes of good luck for my career to do well!! lol.
And I am not a bank sympathiser. Do they exist???? How you try and make a spin on what is ultimately a bad day for claimants is unbelievable and does you or your apparent revolution no credit.0 -
Maybe the problem in this case is that Mr Berwick went in, as he says "expecting to win" and didn't do his homework. It's impossible for us to say, of course, but I think there is a tendency, judging by posts on here, towards the thought that reclaiming bank charges is 'our right'. Subsequently people are not giving it the serious attention it deserves and laying themselves open to wily old banks, who are sitting in their rocking chairs waiting to pick us off. I've just received two offers of settlement by letter, which I hope will be honoured. Does anyone know if they are committed to repayment if they have offered it in a letter?0

The judge did seem to suggest that claims against credit cards were different, in that this is a contract, due to the monthly payment required.
Although, he did not pass comment, am i right in thinking that the two are classed differently by the judge?
I have already successfully claimed against the banks, and i am hoping that this ruling would not apply in any case, to credit cards.0 -
not sure if this has been said (scanned the thread) but, i was lucky enough to get on the consumer action groups site before it crashed. the claimant in question has his own thread running about his claim with lloyds. all he was claiming was for around £1310 charges (mostly o/draft) and right from the outset he added £520 approx interest. other posters , some of them site mods i think advised and questioned him about why he was going for 40% interest ...the claimant didn't seem to have much of an answer, in fact he admitted he might not have worked it out right and kept going with his claim. personally, i wonder how much of the dismissal of this claim was down to him adding way too much interest.
i too started to panic about my claim with the lloyds 'til i read all his thread.0 -
the thread with all his claim outlined by the claimant is called ....
Kevboy_telford Vs LLoyds0 -

40% interest! Wow, that's optimistic. I'm on the verge of submitting my claim but am adding no interest to my amount.0 -
i also have not added interest... i think the interest should be approx 8% if you use the online calculator. a few mods queried him on the high interest though0

IMO abuse is never warranted. Polite but foreceful criticism is, and it should never be ad hominem!
Only got as far as amo amas amas at school old wiring but I agree with you. If you'd have read a couple more items you would have found my apology.
