Have to say that I agree with much of what Tozer has said. Making disparaging comments about the judge, simply because the judgement wasn't in favour of the perceived victim, doesn't mean that asides such as the judge accepting 'backhanders' are justified. That really brings the discussion into a playground domain.
And, as pointed out, as of today and until challenged/overturned, the charges are lawful despite being the decision of a lower court. If the guy doesn't appeal, it'll stand.0 -
If the bank have offered you the full amount of your claim and you have refused it because it didn't include interest, then yes you have weakened your case.0

I just caught the end of the news and it said Lloyds TSB have just won their first court case on unfair charges. Does anyone know anything about this??0 -
As it is money that I never expected to see again then I am not bothered about interest. Any money is better than nothing and as long as the offer isn't below 85% then I would be happy.0

HI all yep the news is filtering through thick and fast now!!! im really :mad: because i have sent off last tuesday the letter advising they have one last chance and then i will take it to court !!!! and guess who my bank is yep youve got it Lloyds Tsb :mad: :mad: :mad: i feel a little deflated along i am sure with thousands of others can anyone offer any comfort or words of wisdom?? thanks0

Tozer, most of the comments made, are not just sour grapes, but from people who have read the ruling.
How can letting a bank win , when they could not even be othered to show , be classed as good legal practice.
Or cristicising the plaintiff, for not proving the real cost of the banks charges, when the banks themselves have refused to even provide them to government depatments.
This judement, as i read it, IS nonsense in paces, wether the outcome was right or wrong.
Lets face it, the bank got away with it today.0 -
No I don't have a claim. In fact I've never paid interest or charges but I have helped others reclaim - have a look at my previous posts before slagging me off. Have a particular look at the posts where I have spent my time (usually charged at £275 per hour) helping people and even drafting court documents.
I am a lawyer specialising in commercial contracts. I have an interest in the legal process and am appalled at some of the gibberish written on here. Rubbish like the judge was incompetent or even corrupt just when a decision doesn't go what is perceived as the right way.
I think I will stop posting on this board as, frankly, I will not waste my time trying to justify the advice that I am giving, in very good faith and dealing with people who not only misunderstand the situation but lack the grace and manners to actually respect other's views. All very sad.
Oh, and the charges are not currently UNLAWFUL. The decision as it stands is that they are LAWFUL. You may not agree, but it is the only decision that stands.
And by the way, you are the one who got personal first. I was merely having a discussion. I only earn 17 per hour. Does that make me unqualified to argue with you. Your childish sentiment ie stoping your 'charity work' on this site because some one disagreed with you, speaks volume. good luck in your career.0 -
