childcare overpayment - help needed

    I would just like to know where I stand with appealing this decision. My childcare provider and my wifes employer have said they will verify childcare and employment again if required by HMRC. In the mean time I will not receive any more tax credits and would like to know if they change their decision after the appeal, will I be entitled to all the missed payments of child tax credit I am owed ? This is really worrying me as we have relied on this for our monthly costs and if I had know about problems associated with childcare, I would have told my wife not to bother getting a job and would rather her stayed at home looking after the children.

    You can appeal and if you are successful it will be backdated.

    There is no requirement that you have to pay for the childcare out of the money, you just need to be paying those childcare costs.

    The only problem is that the appeal may take quite a while to be dealt with.

    I dont mind how long the appeal takes. I know that we have all the paperwork and confirmation that we did rightly claim the childcare. I have now stopped my wife working and will not be claiming childcare anymore. The system is flawed in that they are willing to hand out childcare payments before making any checks and then accuse you of defrauding the system. Id rather they did all the checks first to find out if you are eligible before making any such payments.

    The payments would not have stopped because the money wasn't coming out of your bank - I have never come across that before.....ever. It will either be because the costs were not confirmed as genuine or the actual entitlement to claim CCC wasn't fulfilled.

    Well i rang up the officer dealing with the claim, and he looked at cash withdrawal from my account and it did not add up to the payments we were making for childcare. That's the reason he gave.

    This doesnt sound right - You've got recipts and the ofstead registered childcarer has verified your claim - There really doesn't sound as if they have any geniune reason to stop your claim - I've never heard of any rule that says the payment amounts have to match cash withdrawn from the bank !

    Personally I'd be getting My MP involved and demanding a proper investigation and an apology for your wife having to give up work because you could no longer afford childcare.

    That's exactly what has baffled me. I just don't understand their reasoning for stopping the claim. Is it worth going to Citizens advice bureu ?
