Buyer said not as described... help!

My sister recently purchased some VB jeans on ebay. When they arrived they were a bit too long for her so she decided to resell them. She sold them successfully and the buyer paid promptly. A couple of days later my sister received an email to say that the jeans weren't the size she had stated - my sis said they were 32 but the buyer said they were a 34. My sister hadn't double checked the size when she listed them so told the buyer as long as they were returned in the same condition she would refund her. They have arrived this morning and they are indeed a 32 leg. As they are as described can she just resend them back to the Buyer - my sister has already spent the money!!

The buyer will need refunding though and the OP has said their sister has spent the money receieved for them.
If the jeans are definitely a 32", then I'd email the buyer, explain that they are wrong, the jeans ARE 32" not 34" therefore you cannot refund and will await postage to send them back again.Tank fly boss walk jam nitty gritty...0 -
Have you measured the length? Some of these items end up in the system beacuse the manufacturer has mislabeled them.0

I would refund minus postage costs and ebay fees but only if I was 100% accurate in my listing....but measure them to be sure...0

Some designer jeans are a bit weird like this. My OH reserved some Diesel jeans from Selfridges in a 32" length but when he tried them they were too long. He got the SA to measure them and they measured 34" so he ended up with he 30" which actually measured 32".
When listing clothing I always give the important measurements (leg length, arm length, chest size etc) as I guess different brands vary considerably.

surely the size on the label is wrong, as your sister found out!!
Your sister simply resold them on. Your buyer has returned them to you because they are a bit too long for her
Both cases are the same aren't they??
Perhaps your sister should have explained why she is selling.

She didn’t measure them when she sold them on – she just presumed they were a 32 – which she realises is a little silly now. As she wasn’t sure the correct length she told the buyer that as long as they arrived back to her in the same condition she would refund her in full. The problem is now that they have come back to her she has measured them and they are definitely a 32 leg so the buyer is wanting a refund on postage and the item even though the item is as described. I think if she hadn’t spent the money she would just refund the jeans minus her costs for paypal, selling etc but as she has I’m not sure where she stands with ebay etc.0 -
i would just give a refund of item cost minus any fees incurred, don't give postage or return postage back or offer to return them to the buyer if they pay postage again0

If she really hasn't the money to refund then she is by rights entitled to send them back at he buyers cost....difficult one.....I doubt the buyer will send more money to have them returned to her.
Your sister could suggest reselling them or offering them to next highest bidder and refunding what they get for them...but | do feel the original buyer shouldn't get the full refund.0 -
Always, keep the money as spare until you know the buyer is happy. I've made the mistake of spending it, after sending the item, and then having to refund. It's not worth the hassle, just wait until buyer is happy then spend it!
As she was paid by Paypal I don't think she has a leg to stand on (sorry for the pun, no intention meant). As a seller I've had to refund twice on items that were 'as described' but Paypal have no way of knowing and make it difficult for us.
Is the buyer friendly or being very difficult with their negotiations?Thank you to everyone who posts comps! :A
