    as mine is a weekly period does that mean as long as they give 14 days notice they have served it correctly?

    obviously best outcome is they allow me to sign a new tenancy


    I'll post back as soon as I know anything.

    No.

    S21 states the court will grant possession
    if the landlord "has given to the tenant a notice in writing] stating that, after a date specified in the notice, being the last day of a period of the tenancy and not earlier than two months after the date the notice was given...."
    If the tenancy is weekly, say Monday to Sunday, then the LL must give at least two months notice ending on a Sunday.

    Sorry if this sounds harsh OP, but you really shouldn't be renting with a family (unless it's a secure social house). I've a friend who's wife and daughter have suffered under two unscrupulous landlords, and are now on their third property in three years.
    ..and many families manage to successfully rent within both the private and social sectors.
    Do you have any friends or family that can help with a deposit for a property of your own? In 12 months time, a 5% deposit will be good enough for a decent mortgage deal thanks to the Help to Buy scheme coming into force. That could be your chance to escape the rental sector and provide a more secure home.
    Buying a home is not always possible, whatever "helpful" schemes our beloved Govt may come up with.

    The stuff I copied and pasted was from your local area, there are two systems, temporary and permanent which I believe is the same nationwide. You seem to think you applied for and were granted permanent social housing tho, that needs clarifying.

    One possibility since there are many vacant properties is the housing association intends to renovate them all.

    called them about an hour ago.

    My housing officer was not in Today and so they dont know exact reasons
    but believe it is likely to be due to missed appointments/her thinking we are not living there.

    I care and so I'm not there in the days/or am there very occasionally
    I'm only a few miles away, but obviously, not home

    My partner and kids are regularly out and about.

    also, when it snows, we do try to come and stay at my grans temporarily due to the fact we live on a mountain and no shops etc at all for over a mile and at bottom of mountain, so recently we were away for a few days and also in January

    Gas Check was missed, but re arranged and carried out - all safe

    They did say they should be able to cancel it down?

    I hope it all works out okay 7Seven, It's obviously essential that you get your housing officer back on your side and convince her that you are living there and NEED the accommodation. If you are able to stay elsewhere when it snows, it rather casts doubt on whether you need the place.
    No reliance should be placed on the above! Absolutely none, do you hear?

    its not at all comfortable ( my grans ) but is essential for the kids really.
    all 5 of us in a 2 bed house,
    and is very temporary.

    the snow in Januray was so bad for us that even ambulances were trapped on top of the mountain all night. literally hundereds of cars/public trapped.

    and so after that we decided it safest to arrange to stay on an emergency basis somewhere on "ground" level

    as the snow, due to altitude will last weeks longer than at the bottom.

    (walk time from front door to bottom of mountain in dry good conditions is apprx 45mins. )

    and we are of course, allowed to stay with relatives so long as we arent away for 28 days or longer.

    Property inspection been and done

    They have reports that we arent living here.

    How anyone can say that when everything is here i have no idea

    We have a fully working and fitted kitchen
    Which was installes by us

    We both have very high standards and so our house does look rather done up
    Compared to most here...we have no addictions etc and dont drink or smokr
    So all our money goes toward the children and home.

    extensive decoration to make it look a cosy family home

    All beds/sofas/tvs/xbox bla bla bla is here
    Its a fully functioning family home!!

    She said she was impressed with the property but that was about it!

    She then left saying

    "if they convert your tenancy youll be notified and if there is any problems well give you a call"

    So im just as in the dark as before.

    It looks like the documentation received was due to reports that you weren't living there. They've visited the property while you away and got no answer, then there was the issue about no arrangement made for the gas safety-check so they may have decided that the allegations were true and then issued the paperwork based on that.

    However, now that you've had a home visit, they may have decided that their decision in the first instance was erroneous.

    It wouldn't make any sense to attempt to evict you and lose your rental-income if there's little pressure with long waiting-lists of people desperate to take on your property or the others near you.

    Just thought I'd bring this thread to a close.


    a happy ending really.


    I phoned them not long after the property inspection to ask if we would be allowed to stay and they said yes & to ignore the notice to quit.

    so she was obviously satisfied that we are in fact living at the property and the overall condition of the house, she was quite impressed to be honest.

    so thankfully the worry is over and we can relax once more.
    hoping our tenancy is automatically converted as that will further ease or minds.
