Santander have made me £6000 overdrawn

    Nope. I had no account number for the dormant acct in my Nan's name. How I found out about it was by running a lost account search, through mylostaccounts.org.uk Santander wrote to me confirming they'd found a dormant account in my Nan's name.

    You still have that letter? That should prove helpful in resolving this.

    The fact that Santander has made a mistake on your relative's accounts is not connected to what they have done to you.

    While putting you into the red by their (apparent) incompetence is not very customer friendly, if the money was paid to you accidentally you are still obliged to return it to the rightful owner. I suspect the terms and conditions of your account may allow them to do this without prior agreement. But it is a separate issue.

    I think you have a case for why they should exempt you from charges for a while until you have had the chance to sort out your account. But whether you have a claim for anything else I doubt.

    Did hyou have any reasonable belief that the money paid in was yours? Was it left to you in her will? Was it a debt she owed you? Or did you just think great I will spend it before anyone notices?

    I cannot think of any situation in which I would get £6000 paid to me without expecting it. If it happened I am sure I would not spend it without asking why it was paid to me.

    Re your relatives account, I agree there seem to be questions for Santander to answer and they have already started to take action to resolve the situation. The question arises what did your grandmother's will say, who was the executor/administrator and what did they instruct Santander to do with the money.

    The money wasn't rightfully yours in the first place, so should not have been put in your account. Did you tell them that you were entitled to it or did they assume that?

    Not going to be very easy to sort out unfortunately, particularly over a holiday

    My Nan had a stroke in 2000, where she was completely lost her speak, its quite possible that she could of had an account hidden away that we know nothing about.

    Santander told me it was Nan's money before the paid it into my account, I had not reason to disbelieve them.

    So if the money in your nan's account was left to your mum, then it should not have been given to you in the first place, but gone to your mum. However, if the money is now in your mum's account, and your mum's will leaves it to you, shouldn't you be able to access the money again?

  • The account they actually closed was a joint account between, my Mum & Dad. They told me that it was an dormant account in my Nan's name and it wasn't.

    You're reading it wrong.

    The money she was paid was not from her nan's account - it was incorrectly transferred from a joint account that her mum & dad had and has been returned to her dad.

    When did your Nan die? Did she have a Will? Who was the executor?

    Why would you do such a search? Was this because you were resolving her estate?

    I can see that Santander would write to you after the query but is it really that easy to get your hands on that some of money without any proof you are the rightful owner?

    A few years ago, I wrote to Alliance and Leicester about the account of a relative who had died. They asked me to sign an indemnity before releasing the money. Are you absolutely sure you did not have to do this?
