i'd like to know who you worked for as welll, cos if you saw many cases like this i don't want to inadvertantly shop there ..:DI'm not trained by a 'less than honest retailer' as you suggest i just know know the facts that apply to everyday situations and have seen many cases such as these before.0 -
Like i said its purely my opionion of having worked in retail in real life situations, i know clearly what the law states having studied it at A Level qualification, but in real life situations, its not always the case.
Like i have mentioned and not denied, yes you can go through the retailer within the first 12 months to get your item fixed, but its will be the manufacture who will fix the item and be responsible for the repair, not the retailer (unless an extended guarantee is purchased with the retailer), they will only act as a middle man, hence my advise to go direct to the manufacture.
A retailer will replace an item within 28 days, so its acts a safe guard for the consumer as well as the retailer, and not a 'smoke screen' as you so put it, if you can'nt spot a problem with a item such as a tv within 28 days then there must be something wrong with you IMO, and thats my opinion as a consumer which I'm now.

Stop digging and tell us where you work ?"The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts."

I'm guessing Comet....or Dixons/Currys - these muppets really do tell their 'customers' a load of legal mumbo-jumbo and the problem is they get away with it.
Other posters have quite correctly stated the law on warranties which may or may not differ from what the retailer may think...but is irrelevant, the law is the law. Any problems are the vendors (sellers) problem. Any costs they incur they can seek back from the manufacturer if needs be. Not the consumer.
OP - glad you got video footage, even without it, I'd refuse the £50 as it has no basis. I'd argue if they couldn't find the fault then the engineer is not doing his job properly and take it to court if needs be. The retailer is, as has been demonstrated by 'an insider' here on this forum, just trying to milk some more cash out of you.
Lesson learnt. Don't buy from Comet/Dixons/Currys - no matter how good the deal.Anger ruins joy, it steals the goodness of my mind. Forces me to say terrible things. Overcoming anger brings peace of mind, a mind without regret. If I overcome anger, I will be delightful and loved by everyone.0 -
why did u not ring philips? Thats who your warranty is with not comet!
As other posters have said, you are completely wrong, the retailer is always responsible under the Sale of Goods Act.
The following is taken from THIS DTI page:-
It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.
For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement).
If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the retailer to prove the goods did conform to contract (e.g. were not inherently faulty)
After six months and until the end of the six years, it is for the consumer to prove the lack of conformity.
Retailers who "suggest" 28days etc are just trying it on, their T&Cs do not take precedence over the law
Don`t steal - the Government doesn`t like the competition0 -
a lot of companies do this sort of thing these days.
'if no fault is found we will charge you' (at an extortionate rate)
i just see it as a get out clause.
With all the competiton out there one would have thought comet being a 'traditional' home electricals company would be going the extra mile with their service offerings.
phones4u are another comapny that do a simillar thing (£80 if no fault is found), they almost scare you to stick with the faulty product.
so now what i do is take it back to the store and lie (its a real shame its come to that), i tell them a fault they have no way of inspecting and finding out - something like it just switches off at random for no reason whatsoever. the store gives me a refund or a replacement.

As to the fault - is the console a PS3?
If so it sounds like it could be a HDMI cable problem. Other TVs have had similar problems with the signal that gets sent from the games console to the TV to make sure it's a secure connection doesn't come back fast enough and this can cause the problem described as well as the screen "flashing". I think the TVs already discovered to have this fault required engineers to fix them - although this was free.Never argue with an idiot. He will bring you down to his level and beat you with experience.

agree with the majority here it appears rizel works or worked for a multiple(shed) and not a independant (my opinion) i was under the assumption when i was in retail to be a seller of a product you also had to be able to service it? When i worked for my father whatever tv's we sold we were also service agents for and if a fault occured in the 12 mths we would sort it and put a labour and if necessary parts CLAIM to the manufacturer and get a small amount back for the labour but free partsbe happy!0
