I used the template letter re a 4hr 57min flight delay at Dublin airport last year in respect of a United Airline Flight from Dublin to Washington. Initially the delay was due to crew issues and was further delayed because the baggage door could not be opened to remove baggage.
United have replied 4 weeks after emailing letter . They state the delay was a safety issue and EU261 compensation is not applicable in this case. They say they provided annoucements and meal vouchers, which they did.
While they have declined compensation, as a gesture of goodwill they have included two travel certificates to the value of $125 each for my wife and I to accept as a release of liability.
Is this safety issue phrase a get out clause?
The door was an an issue but only a fraction of the delay i.e. after the initial crew delay passengers did board and had to get off again after.
Should I just accept the certificates or pursue a different course of action please?
