scam/fraud letter from Credit Resource Solutions

    Hi gb12345 If that is the case that the fraudster "took out the loan and used "their" bank details to receive the money and then switched to your details for the repayment" then where would that leave me. Would the loan company have a record that of where the money was sent?

    If it ever went to court (which it wont), they would need to prove it was sent to a bank account in your name, which it clearly wasn't.

    Your HSBC account will show that it hasn't received any money from them and if they try to argue that you had it paid to another account then as dealer wins says, it is up to them to prove that the account it went to was yours and that all the info provided in the application ties up with your details.

    Thanks all I really appreciate all the advice. For what it's worth I have also reported this to the police (I got a incident number) and will be going to have a chat with citizens advice tomorrow morning however I don't think there advice will be as good as I have received here.

    There is probably not much else that CAB can advise you on.

    One last thing on the old HSBC account - if you don't need it cancel it and if you decide to keep it make sure the address is up to date (if you haven't used it for a decade and haven't advised them of any address changes during that time then who knows what info has been sent to the address they have for you)

    Hi all I went to Citizens Advice today. They didn't really help too much but did confirm pretty much all I have heard from all you guys. There is 1 thing worrying me though... If it is an online loan does that the fraudster took out using my details does that mean there will be no signature? I really am worried I could be stitched up without a paddle?

    Quite possibly, but there are other ways of proving that the applicant is not you, such as recording the IP address where the application was made from.

    It is also very likely that some of the details given will not match up (unless the fraudster has a lot of info on you) - for example, if they have just obtained your bank details then it is unlikely that they will know your date of birth.

    Also, the fact that you have only just found out about this when a DCA has become involved would suggest that the address details that were used probably don't match yours either.

    And as I said before, the account that the money was paid into will have been changed between the money going in and the repayment being due to be made.

    Thanks for the advice again gb12345. Yes there would have to be a bank account given for repayments so that is reassuring. However I am not sure how these loans work but could the loan be paid by a cheque which can be cashed anywhere?

    It is very unlikely to have been paid by cheque (if it was then it would strengthen your case as they would have sent the cheque to an address that is not yours).

    Most PDLs "sell" on how quickly you get your money and use bank transfers so that the money is there same/next day.

    I just had a look at the online pay day loan application and they ask for monthly income, take home, employers name, next paydate, and bank account details. I'm feeling a lot more relaxed about things now as none of those would apply to me anyway as I am self emplyed. Also I am remembering that when I rang credit resource solutions they asked me if I "still worked for The Solar Centre Group" so the fraudster must have said he worked for that company which I have never even heard of.
