scam/fraud letter from Credit Resource Solutions

Hi All I any advice on the following would be appreciated...

Yesterday out of the blue I received a letter from Credit Resource Solutions with BIG letters stating "Notification Of Debt Assignment". The amount I apparently owed them was £1744.00. It was to a company called "Lending Stream who they were collecting the funds on behalf of. At first I though "oh no there must be a bill not paid from my past or something" so I called Credit Resourse and they told me it was for a loan I took out in January 2011 and "Lending Stream" were a "PayDay Loan Company". I told them I had NEVER takin out such a loan. They even asked me if I still worked for "The Solar Centre". I informed them that I have been running my own business for the last 12 years and have never heard of "The Solar Centre" anyway. They also asked me if I still had my HSBC account (this must be where the money was supposed to be paid into) I said I had an HSBC account 12 years ago but have never used it since.

Anyway it is all very worrying and confusing as obviously someone back in January 2011 has used my details in order to get a payday loan. However as far as Credit Resource Solutions are concerned I owe them the money and they seemed to be saying to me stuff like "well you would say that" with regards to my denials.

I really would appreciate any help as to what do do next?

    It is up to them to prove that you owe them any money, not for you to prove otherwise.

    Letter when you know nothing about about the debt - AKA "Prove it" letter

    You could adapt that, explaining what you have above.

    In the end though, as long as they have not trashed your credit file by putting info on there, then it's their problem not yours.

    If you didn't take it out and can show that, then even in the unlikely event of court action they would fall flat on their foolish faces.

    First off is the HSBC account still in existence or did you close it? If it is still there but inactive then you need to check with HSBC and see if there has been any activity on it in the last few years.

    Secondly - do not talk to Credit Resourse or Lending Stream any more keep everything in writing.

    You need to send them a "prove it" letter, which basically asks them to prove that you owe the money. Do a search on here and you should find an example (probably in the debt free wannabe area). When you send them the letter (or any other correspondence) DO NOT sign it - just print your name - or give them any other info that they don't already know.

    Hi gb12345 yes I rang HSBC yesterday and they told me that the account is £95 in credit and has NOT been used for over 10 years.

    Also they asked me to send them a cheque for £1 and they would then send me the original paper work. I told them over the phone that I would do that however I have decided against that as then they would have a copy of my sort code, account number and signature.

    They are trying it on with the £1 request. You are only entitled to do that if the debt is actually yours, and it would not have to provide signed copies of any paperwork anyway, so would be utterly useless anyway.

    They need to prove you took out the debt and are liable. Full stop. No exceptions. No fees. Nothing.

    If they can't do that, which if not yours they obviously won't be able to, then they can just "do one" as the saying goes.

    Check your credit file though to make sure they haven't put anything nasty on there,

    Noddle offer a free credit file checking service.

    You will have to enter a your bank details but this is only to verify your details and then you will have free access to your report instantly as I use this service.

    Other than that, you can sign up to Experian on a 30 day free trial.

    Theres experian, Equifax and call credit go for a £2 report.

    Sounds like the fraudster took out the loan and used "their" bank details to receive the money and then switched to your details for the repayment.

    What worries me is that even though i'm a million % certain I never took out the loan how do I ultimately prove that insofar as it is my name and address on the loan?
