PARKING???? charge notice

Got one of them letters from excell in the peel center stockport on my mat at home today. On the day i did park up for about 40 minutes but was just sat in the car enjoying a coffee so as i wasnt going to leave the car i didnt get a ticket. i didnt go into any of the shops, just sat there.
Course the letter is saying its a PARKING charge notice but the only thing thats on the page is a couple of pictures of my car going in and out of the car park. I was part way through writing an email to them saying id pay IF and only IF they could supply me with photographic evidence of my car parked up and also a photo of my dash without a ticket but then i decided to check out the site and now im doubting wether or not to reply at all.
if they want to charge me for parking then surely they should present me with evidence that i was parked shouldnt they? if all they're doing is showing me entering and leaving then regardless of the time frame surely asking me to pay for parking is contrary to their evidence isnt it? its like going into a pub, not buying a drink then being charged for the tax on a pint when you get home.
i want to ignore the letter like so many have said but i also want to see if they would jump through hoops to try and convince me to pay when they havent got any other evidence to force my hand. what should i do????

hi,great post, we love excel on here, bunch of clowns,also i patrol the peel centre regularly and educate unsuspecting motorists about their scam tactics,,you can choose to ignore them as a PARKING charge notice is fake,only a PENALTY charge notice is genuine and must be paid, you do not have that one.expect then follow up threat o grams from,,excel,,roxburghe (we have zero powers) debt collectors and then on the next desk along,oh yes they are,,graham (i am a phoney solicitor )white,threatening everything but the firing squad,again to be ignored.if ur not happy others will be along to tel you about going down the popla route (parking on private land appeals) which will cost the scum known as excel £32-00 to proceed,,,,,beware of anyone pm,,ing you with a low post count as they check this forum daily because we prevent £1000,s of pounds going into their scamming pockets and it may be them in sheeps clothing,,good luck,,but nout to worry about especially excel=scam=fake tickets/invoices=loo paper,,jobs a belter then.0

pretty much backed up what i thought.
What's got me though are these ANPR systems and the tickets that gets sent out from them. even if it were enforceable could someone charge me for parking when the only evidence they have that i was there was the camera on the way in?0 -

I received from your company a PARKING CHARGE NOTICE today (26/03/13) for an alleged contravention which is claimed to have taken place on 14/03/13 at the Peel Centre, Stockport. The reference number you need is XLxxxxxxx.
At this stage I am unable to comply with your request for £60 that you believe to be payable for this alleged contravention for several reasons.
Firstly the signage on the car park at the Peel Centre Stockport is woefully inadequate as have been proven in court previously, most notably in the case brought against your company by Martin Cutts. As such the information telling drivers entering the car park that it is a pay and display can hardly be said to be clear.
Secondly the charge you are requesting is hugely disproportionate to any losses you potentially may have incurred. I returned briefly to check the parking charge at the Peel centre Stockport today and found that you were charging £1.50 for up to two hours so using that as a basic rate i would have needed to have been parked in the Peel centre for about 40 hours to have incurred the charge you are purposing, and just over 66 hours to justify the £100 penalty.
Finally, and most importantly you have not supplied me with sufficient evidence to support your claim. Included as evidence with the PCN are two images showing my vehicle entering and exiting your car park but no evidence of my vehicle being parked or left unattended in a way that could be considered parked. You also claim that as part of the contravention that I parked without a valid ticket but you have supplied no evidence of this such as a photograph of the windscreen or dashboard of my vehicle showing this nor was I approached by anyone identifying themselves as a member of your company during the time stated. As you are not charging for entry or exit from the car park in the Peel Centre Stockport, the evidence included supports... nothing.
This is a PARKING charge notice, not a PENALTY charge notice or a fine and you have no evidence of any actual parking having taken place or not and thus no evidence of a contravention. Even if you did as a private company I’m in no way required by law or statute to reply to this notice
or to pay any charge you make to me as all you have sent me is an unenforceable invoice. I am replying ONLY as a courtesy.
THIS IS NOT AN APEAL.
Please be aware that I shall view any other correspondence from your company as harassment and you shall not receive any further correspondence from me. Should you wish to take this further i will be more than willing to go via POPLA and if needs be see you in court.0 -

Ignoring has worked hundreds of thousands of times and offers the best defence in the off chance they do try one.Be happy...;)0 -
That won't work because the signs have been changed a bit since Martin Cutts was there - he mentioned the change in the signs on his website. Not saying they are perfect, or that you can't appeal/complain/laugh at Excel - far from it - but if you fire that letter off you will just get the response that the signs have been changed.
Why don't you just 'search this forum' (top right above the thread list of this parking forum) and change the option to 'show posts' using the keywords 'Peel Centre Excel'. You'll find loads of recent stuff about this place - the 'Martin Cutts experience' was ages ago and now, since the Protection of Freedoms Act, there is now POPLA to be aware of - and there are plenty of other points to be made if you want to appeal.
And when you've read our threads about the Peel Centre you could do worse than read all the discussion about 'ignore or respond' on this great thread on pepipoo:

For info, it is long established that to be 'parked' you neither need to leave the vehicle or turn off the engine. If your wheels stopped turning, then it is fair game. Don't get involved with the semantics, it won't stop the begging letter chain. You have better things to do with your time than ramp up righteous indignation at their antics.
They'll get bored and move on - if you don't rise to their bait, they get bored quicker.0 -

got a second letter from them today. it was a cunningly worded invitation for me to pay them £100. its now in the drawer with the first one.
to be fair even though i know id win im not 100% about just leaving it. just hope it does go to court as itll be at their expense but id muych much rather that they just !!!!!!ed off and left me alone.0 -

Putting in a 'soft' appeal to the PPC followed by one to POPLA is probably the best way for them to be 'just !!!!ed off' and for you to be 'left alone'

It's too late - he's had the Notice to Keeper over a month ago and could have used POPLA to cancel this then. Can't now (even if the PPC pretend he can still 'appeal' that's just to draw people into responding now). The second letter is not one to respond to, when the first was a postal PCN to keeper already.
So Teegro you should just keep filing and ignoring the letters now, they'll be as shown here (more or less, with the odd sentence about the Protection of Freedoms Act now added for general intimidation):
