Other people parking in my Car Park Space

Hi, I live in a leasehold flat and i have a parking space which I pay a lot of money for each year to the Flat owners. Every so often people park in my space, which is a pain as there's nowhere else nearby to park legally.

The parking is under the flat and is accessed via a electronic fob to operate the gate shutter (which is often vandalised by people in the flats who haven't got fobs)

Can people just park there in my numbered space as it's on private property ? even though I pay a yearly fee to the freeholders/management of the block of flats.

they also park in the communal areas which can make it very difficult at times to shunt around. Is it right that private companies cannot legally clamp/fine people parked on private property anymore?

any other thoughts/views appreciated.

    Why not talk to the other tenents and het an unlockable post in each bay.

    You certainly would not want a car that's in your bay to be clamped and stuck there longer there would you, that would be daft?! Your car would fall victim as well, BTW. And of course clamping has been made criminal - about time too. :D

    Do not even think about getting a private parking company in, do not even go there. Yours will be the first car with a fake PCN (which you can ignore anyway) because they will swoop if and when you have to park out of the bay. That would cause unnecessary hassle and letters bothering you for months!

    Best way to deal with this is at an AGM of residents or asking if you can put a temporary bollard or two there when you leave the space - or a permanent lockable bollard (pretty cheaply purchased BTW). If no AGM then just go with the temporary bollards idea or other obstruction you can leave there in place of your car. A chain, blocks, anything you can whip out of your boot before leaving each time and place in your bay - other residents will soon get the message that your space is out of bounds.

    Alternatively just stick your own Parking Charge Notice on the offending car. It will have just as much legal authority as any issued by a private parking company. Apparently about 60% of people who receive one will pay up straight away. It won't solve your problem but the occasional price of a good meal for two might make you less aggrieved.:)

    If possible you should look at bollards, or some other form of blocking the space, these can be put in by using floor bolts, you may need permision to install them, but if its done correctly you should be able to remove them with little or no damage to the infrastructure ( other than a few threaded holes)

    Asside from that, I would be more concerned with the damage that is being inflicted on the gates/keyfob system

    This is something that should be addressed by you to the management comittee, as it has a negative effect on what should be an extremely secure and safe car parking facility, especialy if your vehicle insurance company believes that your vehicle is parked in a secure garage, and has adjusted your premium as a result.
    If the insurance company thinks your vehicle is securly parked, and its not then there may be some difficulty should you try and claim for theft/damage.

    I know its a pain but I would (in your shoes) install something like this, If you have anyone in engineering you can get one made for a few quid

    I don't think that an unlockable post is going to be much use. But a lockable one might be.
    I can afford anything that I want.
    Just so long as I don't want much.

    I was thinking along the lines of clamping in the communual areas which block mine and other cars getting in and out. I wouldn't be daft enough to get them clamped in my space.
    a few were clamped last year but now the laws changed.

    I know there's a lot of people who don't like the clamping, but in my case i'm paying 500 quid plus for the priveledge for a parking space with my flat number on it with a sign saying parking for flat number **** only. Admittedly it's not parked in much by other residents, but one guys doesn't seem to think it's an issue when i ask him to move it asap. I wouldn't park up someone elses drive.

    The bollard set up would be a pain in the !!!! as we use the space several times a day sometimes, might look a bit petty to as only 1 other guy has one in the far corner out of the way more. loads of the guys hang about a bit too which is a bit intimidating for my partner driving in and out etc. don't get any hassle but they do stand and watch while drinking beer or a bit of a smoke.

    Well they wouldn't clamp in the bays (before) as there wasn't any permits needed to be displayed on the cars. I wouldn't leave my car in others spaces anyway, and I didn't parked in the communal bits which would actually stop cars from getting out completely, and sometimes in. You'd be ok with being blocked in for hours on end then?

    There was signs about 3 foot square put up all over the walls so they were not consealed in anyway. These were periodicly taken down and had to be replaced at times. at the flat owners expense ultimately.
