No, they have refused to do anything. As I say, I am now left with a refurbished HTC One X+ that does not work.
I am looking at further action which is why I wanted to find out if their (inaction) constitutes a breach of contract
Here is the information from which? on how to take them to the ombudsman

htc one stock has been delayed. I don't think anyone has received that handset yet. Check with local phone shops and they might be able to give you an idea of when they will be available. That will give you an idea of when Vodafone might send you the phone.0

A refurbished phone is not deemed to be second-hand, so don't let this mislead. Indeed, often these white box refurbs are inherently more reliable as they've been usually given new shells, flashed with the latest firmware, and and a full diagnostic check - new phones are not individually diagnosed, only samples of the production run.
A lot of course depends on the firm contracted to do the refurbs, but I've never been disappointed with the 10 plus exchanged ones I've had.0 -

Hi all,
Sorry for the delay in responding. I have been a little unwell over the last few days and so unable to check for updates. Thank you though very much for all your thoughts. After seeking further advice from a number of different organisations, it seems that this matter would be covered under both breach of contract and SOGA. The contract arose when Vodafone offered me a resolution via email (the HTC One handset) which I then accepted. This offer and acceptance constitutes under law a legally binding contract. Anyway, I will update as and when poss.
Oh and Lee, sorry but I'm tired of dealing with Vodafone. I will deal with this matter through a more formal route.0 -
I have had similar issue with Vodafone lately defective (alleged quality assured) handset sent in place of handset that they couldnt fix. rang told them broke got told was lucky to have it and they only had to send me basic handset, which I pointed out not the point as its a replacement thats broken, and its made out like my fault. they refuse to send me new handset but offered me lower spec ones saying I couldnt have a better one and they dont have any that I had. offered me £10 credit. not happy so complained officially but fobbed off they wont follow there own complaints procedure and escalate. Im told even though the customer service I have recieved is appalling my issue isnt with them but the maker of the phone -funny that as its them taking my money each month.
Im told its all in paragraph one of the terms but havent seen it and pretty sure terms have been broken in relation to not providing adequate replacement.
They have sent off the broken handset that replaced the broken handset for repair and say they wont do anything else. So more trips in my lunch times to local store and wasted phone calls (approx 2hrs)
so have reported them to ombudsman to see if I can get some help. Again told Im valued customer - not sure they understand the english language because there definition of valued is much different to mine.
let us know how you get on0 -
