    Start by hitting him with the CSA and refuse to agree the overnight visits at the moment.

    Your problem is that without a residency award, he can just take them and refuse to return them.

    It is on the CSA calculator!!!

    It asks how many nights they stay and if it is 52-100 it isreduced and 100 nights or more it says nothing is payable.

    Erm, no it isn't?

    I put in that if a NRP earns £350 a week and has his 2 kids 3 nights a week (156 a year) then he will have to pay £40 a week.

    Well you come tell them because when I appealed they knocked a further £2 off!

    That must be a different one.. the one I looked at (ages ago) was less tan 52 nights 52-100 nights and 100+

    If maintenance were being paid for the children via the csa, then their dad would pay a reduced amount if he had them for 3 nights a week. However he would not be completely exempt from paying maintenance.

    You could check on the csa calculator and find out how much you should be recieving in maintenance. I think it is very sad when one parent does not see the bigger picture and want to contribute a fair amount to raise their children. Even sadder when they put work ahead of important elements of their childrens lives. Many employers are reasonably flexible and will allow for parents to be there for their children.

    I suggest taking legal advice with regards to sorting out splitting your joint assets. Especially as you are currently paying the mortgage by yourself. I dont know how that may effect the split but if I were in your shoes I would want things to be done fairly.

    If they have been staying overnight 3 times a week then this might be a bit hard and upsetting for them, to now not be allowed to sleep at his?

    I implore you, if your only reason for refusing overnight contact is to keep up your maintenance payment, then please reconsider.

    A children's right to a relationship with a parent is priceless IMO.

    Are you sure these figures dont refer to percentages?
