LETTER BEFORE ACTION
Dear Ms. XXXXX
Thank you for your e-mail clarifying Avis's position regarding Avis paying the Charge Notice XXXXXXXX.
l am now writing to you to request a full refund of the £75 which Avis charged to my credit card on 14/03/13 without autherisation and in my view unlawfully. l respectfully request that this refund be carried out within 7 days. Should Avis fail to fully refund me within that time l will take further action for which l will also seek any costs incurred.
l will now set out the full reasons for requesting full refund of the £75.
You are in breach of your own terms and conditions,TPS who sent you the Charge Notice are a Private Parking Company. The Charge Notice is nothing more than a speculative invoice. It is not a fine, [/quote] and it is not a penalty, and it is not issued by any statory authroity.

Too late to change it now guys, already been sent. l already tried asking Avis in what l regarded as simple terms, but still got the brush off.
Thought it was better to cover all points to highlight their short comings, and hope they'll take this a bit more seriously.0 -
I used to deal with Avis/GE with lease cars, and their admin is totally useless.
I got a road tax disc from them six months after leaving my company, when I phoned to inform them, them they said they wouldn't accept my instructions it had to come from the company.
Perhaps they think they could pay a speeding fine on your behalf too without contacting you first!0 -
Just an update. l have finally received a full refund from Avis today  Many thanks for all the advice. This was their final reply after going through various departments.
Thank you for your e-mail regarding the levied charge that appeared on your account. This case has been passed to me to personally investigate it for you.
While I do appreciate your disappointment regarding this matter, I would like to inform you that Landowners who allow parking on their land often outsource the enforcement to a third party. Car parks for supermarkets and other large retail premises often operate in this was. The contract between the car park user (the vehicle driver) and the private parking operator is broken if, for example, the driver outstays a time limit on parking, or occupies a space reserved for categories of car park user to which they do not belong, such as residents or employees. In such instances, the landowner or their agent can lawfully obtain registered keeper details from the DVLA and issue a parking charge notice.
In your case the procedure was not followed precisely by our colleagues, therefore while you are responsible for this traffic contravention, we refunded the debited amount of GBP75.00 to your Visa card ending XXXX on 11th April as a gesture of goodwill. This amount should be reflected on your account within this work week.
Thank you for bringing this matter to my attention and giving me the chance to assist you. I hope that with my reply we can bring this matter to a satisfactory conclusion.
Yours sincerely,0 -
"traffic contravention"! They still don't get it do they? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Completely delusional, they are either so stupid that they truly believe the baloney that they just sent you. Or they know they don't have a leg to stand on and want to save face. But the main thing is that they've given your money back, well done on that. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Well done, another success against a daft hire company. I wonder if the idiots that work there would actually pay a fake PCN if ever they got one? Deluded!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
