So asda engages this company to infest the car park, so they are the agents of asda, and they refuse to cancel the ticket, who is exactly in charge here the major retailer or a two bit parking company ? If this is not cancelled by Monday take it to the head office.

went to Asda today and complained to the manager, he got his assistant to ring smart parking and asked them to cancel it, but they said I had parked in a mother and baby space , the space next to me had the symbol on the floor but not the space I parked in. I told the manager that if he did not cancel this then I would write to my local paper and would not shop there again, he admitted that the car park did belong to asda so I asked him why my mother, who can only walk a couple of steps is not allowed to park in these spaces anyway, although I did stress that I had not done this, anyway he said if they did not cancel the ticket he would do his best to get it cancelled. Due in asda again on Monday and if I have not heard from him by then I will fill up the trolley and do as you all suggest, whatever happens they are not getting a penny from me
THANK YOU ALL FOR YOUR GREAT ADVICE, MUCH APPRECIATED

Your Mum legally can have the car parked in a disabled bay. She IS disabled. Stop trying to 'appeal' that you didn't park in a special bay because you CAN.

And parent & child bays mean absolutely NOTHING in law. Quite right too - a dreadful gimmick by the retailers which just gives lazy parents the idea they have the same rights to a 'special bay' as people like your Mum...(yes I am a parent of 4 kids but I also know what the priority should be, and legally/morally it's disabled people like your Mum, not parents and babies who can park anywhere but get it into their heads they have a right to a disabled bay if the gimmick 'P&C bays' are full).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It's like the CIA doing extraordinary rendition to third countries so they can deny they are torturing people on US soil.
  • just to let you all know, I went back to asda but the manager said he could not contact the lady at smart parking as she was on holiday so I told him that I expected him to sort this out today, He said he would let me know when he had spoken to smart parking to which I said that I would not be paying any fine anyway! His reaction was to shrug his shoulders so I told him that I had written a letter of complaint that I will be sending to Walmart in the USA, all of a sudden he told me he would cancel the ticket and apologised so perhaps other customers with unfair parking tickets should try this as obviously they do not want their American partners to know what is going on here!!

I hope you didn't use the word "fine" when talking to him.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • yes, sorry I did but in a very sarcastic way, never seen anyone go quite that red so quickly!

Can always check their signage if you wanted to cost them a bit later down the line? After all, Smart Parking is the company name on the actual tickets theirselves, but you'll see no mention of them on most of their signage, it'll show TCP. Can't see how you can enter into a contract with Smart Parking without seeing their signs!

Maybe someone else with more experience will confirm my trail of thought on this one.
