Delay Compensation

I wrote to Jet2 with all my details regarding our delay and received a letter back saying i am unable to claim due to extroadinary circumstances and these are excluded under regualtion 261/2004.. Specifically the delay was caused by an unexpected safety shortcoming to the aircraft! and am not entitled to any compensation on this occasion

Has anybody else experienced this and does anyone know if this is correct or they are just fobbing me off thinking i wouldnt take it any further.

    this seems to be Jet2's answer to every single claim for delays. i still haven't heard of anybody having a positive outcome from jet2. there are a few people on this forum seem to be close to taking jet2 to court. I'm waiting to see the outcome of this.

    I'll tell you why? I have a case with the CAA and I don't want to predudice any court case by NOT allowing the CAA to make a judgement. (although reading between the lines the CAA don't seem to believe that planes with technical difficulties are the fault of jet2)

    If the cases are so close to fruition then why not wait another couple of weeks. The first letter to jet2 was written last August.

    The CAA don't have any teeth to force the airline to compensate you, if you have a case, pursue jet2.

    Have a go at a search for it. As a newbie, there's lots of very useful info to find in these forums so it'd be a good start.

    I did look for it but couldnt find it. Although a newbie to this forum I am a seasoned member of several other forums.I did a search for lewroll and I did find a reference to Lewroll getting paid out after starting small claims procedure but I couldn't find the post itself.

    was the small claim via mcol or his local small claims court?
